Un paiement d\u2019\u00e9galisation est une somme d\u2019argent qu\u2019un conjoint mari\u00e9 verse parfois \u00e0 l\u2019autre conjoint apr\u00e8s une\u00a0s\u00e9paration ou un d\u00e9c\u00e8s de l’autre\u00a0partenaire. Il vise \u00e0\u00a0partager l\u2019augmentation de la valeur des biens du couple survenue durant leur mariage.<\/p>\n

Pour d\u00e9terminer le montant du paiement d\u2019\u00e9galisation, chacun des partenaires calcule la valeur de ses biens familiaux nets<\/a>. Le partenaire qui obtient la valeur la plus \u00e9lev\u00e9e y soustrait celle de l\u2019autre partenaire pour obtenir la diff\u00e9rence, qu\u2019il divise ensuite en deux afin d\u2019\u00e9tablir le paiement d\u2019\u00e9galisation qu\u2019il doit verser.<\/p>\n","protected":false},"author":3,"featured_media":0,"template":"","legal-topic":[42146,42152],"class_list":["post-1179902","glossary-term","type-glossary-term","status-publish","hentry","legal-topic-family-law","legal-topic-wills-and-powers-of-attorney"],"yoast_head":"\npaiement d'\u00e9galisation -
