Le crit\u00e8re est diff\u00e9rent selon la question de droit de la famille examin\u00e9e.<\/p>\n<p>Par exemple, quand il faut trancher la responsabilit\u00e9 d\u00e9cisionnelle (avant appel\u00e9e \u00ab&nbsp;garde&nbsp;\u00bb) et le temps parental (avant appel\u00e9 \u00ab&nbsp;droit de visite&nbsp;\u00bb), le crit\u00e8re juridique tient entre autres compte&nbsp;:<\/p>\n<ul>\n<li>de la s\u00e9curit\u00e9 et du bien-\u00eatre physique, affectif et psychologique de l&#8217;enfant;<\/li>\n<li>de la relation entre chacun des parents et l&#8217;enfant;<\/li>\n<li>de l&#8217;opinion et des souhaits de l&#8217;enfant, s&#8217;il peut s&#8217;exprimer;<\/li>\n<li>des mauvais traitements qu&#8217;auraient pu subir l&#8217;enfant ou d&#8217;autres membres de la famille.<\/li>\n<\/ul>\n<p>Dans les affaires de protection de l&#8217;enfance impliquant une soci\u00e9t\u00e9 de l&#8217;aide \u00e0 l&#8217;enfance, le crit\u00e8re juridique tient notamment compte&nbsp;:<\/p>\n<ul>\n<li>de l&#8217;opinion et les souhaits de l&#8217;enfant, s&#8217;il peut s&#8217;exprimer;<\/li>\n<li>dans le cas d&#8217;un enfant inuit, m\u00e9tis ou de Premi\u00e8res Nations, de l&#8217;importance de pr\u00e9server l&#8217;identit\u00e9 culturelle de l&#8217;enfant et les liens qui l&#8217;unissent \u00e0 la communaut\u00e9, m\u00eame s&#8217;il n&#8217;en est pas un membre officiel;<\/li>\n<li>de la race, du lieu d&#8217;origine, de la couleur, de l&#8217;origine ethnique, de la citoyennet\u00e9, de la diversit\u00e9 familiale, du sexe et de l&#8217;orientation sexuelle de l&#8217;enfant.<\/li>\n<\/ul>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"author":3,"featured_media":0,"template":"","legal-topic":[42154,42161,42146],"class_list":["post-1179930","glossary-term","type-glossary-term","status-publish","hentry","legal-topic-child-abuse-and-neglect","legal-topic-domestic-violence","legal-topic-family-law"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v23.9 (Yoast SEO v23.9) - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>int\u00e9r\u00eat sup\u00e9rieur de l&#039;enfant - Justice pas-\u00e0-pas<\/title>\n<meta name=\"description\" content=\"L&#039;int\u00e9r\u00eat sup\u00e9rieur de l&#039;enfant est un crit\u00e8re juridique utilis\u00e9 par le tribunal pour prendre bon nombre de d\u00e9cisions concernant les enfants.
