La plupart des infractions criminelles sont des infractions \u00ab hybrides \u00bb. Cela signifie que la Couronne se base sur les faits propres \u00e0 chaque cas pour d\u00e9cider s’il convient de poursuivre l’affaire comme une infraction sommaire ou comme un acte criminel :<\/p>\n

  1. Les infractions punissables sommaires<\/strong> sont consid\u00e9r\u00e9es comme moins graves. Elles sont jug\u00e9es par la Cour de justice de l’Ontario, o\u00f9 la proc\u00e9dure est plus simple et plus rapide. Il n’y a jamais de jury. Un juge tranche seul. La peine maximale est de 2 ans d’emprisonnement, ou une amende de 5\u00a0000\u00a0$, ou les deux.<\/li>\n
  2. Les actes criminels<\/strong> sont consid\u00e9r\u00e9s comme plus graves. Ils sont jug\u00e9s par la Cour sup\u00e9rieure de justice, o\u00f9 la proc\u00e9dure est plus complexe et plus longue. Certaines affaires sont jug\u00e9es par un jury et d’autres par un juge. La peine maximale est souvent sup\u00e9rieure \u00e0 2 ans d’emprisonnement.<\/li>\n<\/ol>\n

    La proc\u00e9dure des tribunaux pour adolescents<\/a> et les peines prononc\u00e9es<\/a> sont diff\u00e9rentes.<\/p>\n\n\n
