C\u2019est parfois le cas, comme dans les exemples suivants.<\/p>\n<h3>Mise \u00e0 pied temporaire<\/h3>\n<p>Selon la Loi sur les normes d\u2019emploi (LNE) de l\u2019Ontario, vous <strong>pouvez \u00eatre mis \u00e0 pied<\/strong> sans pr\u00e9avis de licenciement si la situation est temporaire.<\/p>\n<p>Par contre, les r\u00e8gles de la LNE ne s\u2019appliquent <strong>que si<\/strong> vous avez accept\u00e9 que votre employeur puisse vous mettre \u00e0 pied temporairement. Par exemple, votre contrat de travail pourrait le mentionner. Si vous \u00eates membre d\u2019un syndicat, les r\u00e8gles d\u00e9pendront de ce que dit la convention collective.<\/p>\n<p>Si votre employeur n\u2019avait pas le droit de vous mettre en mise \u00e0 pied temporaire, il pourrait devoir vous verser votre indemnit\u00e9 de d\u00e9part comme si vous aviez \u00e9t\u00e9 cong\u00e9di\u00e9.<\/p>\n<p>Les r\u00e8gles de la LNE concernant la mise \u00e0 pied temporaire sont compliqu\u00e9es.<\/p>\n<h3>Combien de temps une mise \u00e0 pied peut-elle durer?<\/h3>\n<p>En g\u00e9n\u00e9ral, une mise \u00e0 pied temporaire peut durer 13 semaines ou moins sur une p\u00e9riode de 20 semaines cons\u00e9cutives.<\/p>\n<p>Dans certains cas, cela peut durer plus longtemps. Par exemple, si\u00a0votre employeur continue de mettre de l\u2019argent dans votre r\u00e9gime de retraite, la mise \u00e0 pied temporaire peut durer jusqu&#8217;\u00e0 34 semaines pour une p\u00e9riode de 52 semaines cons\u00e9cutives; ou<\/p>\n<p style=\"text-align: left;\">Si vous <span>n&#8217;\u00eates pas membre d&#8217;un syndicat, <\/span>votre employeur peut vous mettre en mise \u00e0 pied temporaire prolong\u00e9e, c\u2019est la meme chose que ce qu\u2019on appelle en droit un cong\u00e9diement implicite. Vous avez les m\u00eames droits \u00e0 l\u2019indemnit\u00e9 de licenciement que si vous aviez \u00e9t\u00e9 <a href=\"\/fr\/questions\/employment-and-work\/jai-\u00e9t\u00e9-cong\u00e9di\u00e9-\u00e0-combien-de-jours-de-pr\u00e9avis-ai-je-droit\/\">cong\u00e9di\u00e9<\/a>.<\/p>\n<p>Si vous avez \u00e9t\u00e9 mis \u00e0 pied, vous devrez peut-\u00eatre <a href=\"\/fr\/questions\/employment-and-work\/o\u00f9-puis-je-obtenir-de-laide-et-des-conseils-relativement-\u00e0-mes-droits\/\">demander des conseils juridiques<\/a> pour savoir si votre employeur a le droit de vous mettre \u00e0 pied temporairement. Et si vous acceptez par \u00e9crit, cela peut \u00eatre 51 semaines ou moins sur une p\u00e9riode de 78 semaines cons\u00e9cutives.<\/p>\n<h3>Si vous \u00eates cong\u00e9di\u00e9 pour un &#8220;motif valable&#8221;<\/h3>\n<p>Votre employeur peut dire qu\u2019il vous a cong\u00e9di\u00e9 pour quelque chose que vous auriez fait.
