Ils ne veulent pas donner une raison que vous pourriez utiliser pour prouver qu&#8217;ils n&#8217;ont pas respect\u00e9 la loi.<\/p>\n<p>Il y a des raisons qu\u2019ils <strong>ne peuvent pas<\/strong> utiliser pour cong\u00e9dier quelqu\u2019un. C\u2019est contre la loi pour un employeur de vous cong\u00e9dier pour une de ces raisons.<\/p>\n<h3>Raisons interdites par la loi<\/h3>\n<h4>Droits pr\u00e9vus par la Loi sur les normes d\u2019emploi (LNE)<\/h4>\n<p>La loi dit que votre employeur <strong>ne peut pas vous cong\u00e9dier<\/strong> pour avoir fait quelque chose que la <span class=\"glossary\">LNE<\/span> vous donne le droit de faire<em>.<\/em><\/p>\n<p>Voici quelques exemples de ces droits\u00a0:<\/p>\n<ul>\n<li>Prendre un cong\u00e9 de maternit\u00e9 ou un cong\u00e9 parental;<\/li>\n<li>Poser des questions concernant vos droits ou demander \u00e0 l\u2019employeur de respecter la loi;<\/li>\n<li>Refuser de signer une entente qui modifie vos droits, par exemple une entente sur la <a href=\"\/fr\/questions\/employment-and-work\/un-employeur-peut-il-me-demander-de-signer-une-entente-sur\/\">mani\u00e8re dont vous serez pay\u00e9 pour les heures suppl\u00e9mentaires<\/a>;<\/li>\n<li><a href=\"\/fr\/questions\/employment-and-work\/comment-puis-je-presenter-une-reclamation-relative-aux-normes-demploi\/\">D\u00e9poser une r\u00e9clamation<\/a> contre votre employeur aupr\u00e8s du minist\u00e8re du Travail;<\/li>\n<li>Donner de l\u2019information concernant votre employeur \u00e0 un agent des normes d\u2019emploi du minist\u00e8re du Travail.<\/li>\n<\/ul>\n<h4>Droits de la personne<\/h4>\n<p>Votre employeur enfreint la loi s\u2019il vous cong\u00e9die pour une raison contraire au Code des droits de la personne de l\u2019Ontario. Par exemple, dans plusieurs situations, il est interdit de cong\u00e9dier quelqu\u2019un pour les raisons suivantes :<\/p>\n<ul>\n<li>la race, la couleur, l\u2019ascendance, l\u2019origine ethnique, la citoyennet\u00e9 ou le lieu de naissance;<\/li>\n<li>les croyances religieuses;<\/li>\n<li>un handicap physique ou mental, y compris une d\u00e9pendance;<\/li>\n<li>le fait d\u2019avoir des enfants, de pr\u00e9voir en avoir ou d\u2019\u00eatre enceinte;<\/li>\n<li>l\u2019\u00e9tat matrimonial (p.\u00a0ex., personne mari\u00e9e, divorc\u00e9e, c\u00e9libataire ou en union de fait);<\/li>\n<li>le sexe;<\/li>\n<li>l\u2019orientation sexuelle, l\u2019identit\u00e9 sexuelle ou l\u2019expression de l\u2019identit\u00e9 sexuelle.<\/li>\n<\/ul>\n<h4>Autres droits<\/h4>\n<p>La loi interdit \u00e0 votre employeur de vous cong\u00e9dier parce que vous avez pos\u00e9 des questions en lien avec la sant\u00e9 ou la s\u00e9curit\u00e9 au travail.
