La loi appelle cela un licenciement implicite.<\/p>\n<p>On parle de cong\u00e9diement implicite si votre employeur fait quelque chose\u00a0:<\/p>\n<ul>\n<li>qui apporte un profond changement \u00e0 votre situation professionnelle et;<\/li>\n<li>qui est contre votre gr\u00e9.<\/li>\n<\/ul>\n<p>Dans ce cas, c\u2019est comme s\u2019il vous cong\u00e9diait. Donc, si vous quittez votre emploi, vous aurez les m\u00eames droits que si vous aviez \u00e9t\u00e9 cong\u00e9di\u00e9. Vous aurez notamment droit \u00e0 l\u2019indemnit\u00e9 de licenciement ou \u00e0 l\u2019indemnit\u00e9 tenant lieu de pr\u00e9avis.<\/p>\n<h3>Changements qui n\u2019\u00e9quivalent pas \u00e0 un cong\u00e9diement implicite<\/h3>\n<p>L\u2019employeur peut apporter bien des changements qui n\u2019\u00e9quivalent <strong>pas<\/strong> \u00e0 un cong\u00e9diement implicite. Certains sont trop mineurs, comme le fait de vous demander de travailler \u00e0 un autre endroit de la m\u00eame ville.<\/p>\n<p>Ou alors vous avez d\u00e9j\u00e0 accept\u00e9 de voir changer certains aspects de votre travail. Par exemple, votre contrat de travail indique peut-\u00eatre que l&#8217;employeur peut changer votre horaire.<\/p>\n<h3>Changements qui \u00e9quivalent \u00e0 un cong\u00e9diement implicite<\/h3>\n<p>Voici quelques exemples de changements qui <strong>pourraient<\/strong> \u00eatre si importants qu\u2019ils \u00e9quivalent \u00e0 un cong\u00e9diement\u00a0:<\/p>\n<ul>\n<li>Votre employeur r\u00e9duit de beaucoup votre salaire ou refuse de vous verser l\u2019argent qu\u2019il vous doit.<\/li>\n<li>Il vous retire des fonctions essentielles et classe votre poste \u00e0 un niveau inf\u00e9rieur.
