Les services essentiels sont l&#8217;eau chaude ou l&#8217;eau froide, le chauffage (du 1er septembre au 15 juin), le combustible, l&#8217;\u00e9lectricit\u00e9 et le gaz naturel.<\/p>\n<p>La loi interdit \u00e0 votre <span class=\"no-glossary\">propri\u00e9taire<\/span> de couper ou d&#8217;interf\u00e9rer avec un service essentiel.<\/p>\n<p>La m\u00eame r\u00e8gle s&#8217;applique aux services en mati\u00e8re de soins et la nourriture.<\/p>\n<p>Votre <span class=\"no-glossary\">propri\u00e9taire<\/span> n&#8217;a pas le droit d&#8217;interrompre ou d&#8217;interf\u00e9rer avec ces services pour quelque raison que ce soit, m\u00eame si vous devez un loyer.<\/p>\n<p>Des services comme l&#8217;Internet, la climatisation, la blanchisserie et le t\u00e9l\u00e9phone fixe ne sont <strong>pas<\/strong> des services essentiels. Mais vous pouvez toujours prendre les m\u00eames mesures que celles mentionn\u00e9es dans cette question. La diff\u00e9rence entre les services essentiels et les autres services est que la Commission de la location immobili\u00e8re (CLI) ou l&#8217;Unit\u00e9 d&#8217;application des mesures l\u00e9gislatives en mati\u00e8re de logement locatif (UAML) peuvent ordonner des sanctions plus s\u00e9v\u00e8res lorsque les propri\u00e9taires coupent ou interf\u00e8rent avec les services essentiels.<\/p>\n<p>Si votre <span class=\"no-glossary\">propri\u00e9taire<\/span> a coup\u00e9 votre climatisation, vous devriez d&#8217;abord lire la question <a href=\"\/fr\/steps\/housing-law\/1-sachez-si-votre-proprietaire-peut-vous-empecher-davoir-un-climatiseur\/\">Quelles sont les r\u00e8gles entourant les climatiseurs ?<\/a> pour savoir si votre <span class=\"no-glossary\">propri\u00e9taire<\/span> peut vous emp\u00eacher d&#8217;avoir un climatiseur.<\/p>\n<h3>Avant de pr\u00e9senter votre requ\u00eate \u00e0 la CLI<\/h3>\n<p>Si votre <span class=\"no-glossary\">propri\u00e9taire<\/span> a coup\u00e9 ou menace de couper un service, vous pourriez r\u00e9soudre le probl\u00e8me en communiquant avec votre <span class=\"no-glossary\">propri\u00e9taire<\/span> ou en <a href=\"\/fr\/questions\/housing-law\/mon-proprietaire-peut-il-couper-lelectricite-ou-mes-autres-services\/\">faisant ces d\u00e9marches d&#8217;abord<\/a>.<\/p>\n<p>Vous pouvez \u00e9galement communiquer avec l&#8217;<a class=\"links-link ext new-link\" href=\"\/fr\/resource\/infractions-liees-au-logement-locatif\/\" target=\"_blank\" rel=\"noopener\">Unit\u00e9 de l&#8217;application des mesures l\u00e9gislatives en mati\u00e8re de logement locatif<\/a> (UAML). Cet organisme gouvernemental tentera de faire r\u00e9tablir votre service. Songez aussi qu&#8217;apr\u00e8s avoir re\u00e7u une <a href=\"\/fr\/legal-topic\/help-lawyers-and-paralegals\/finding-lawyer-or-paralegal\/\">lettre d&#8217;un avocat ou d&#8217;un parajuriste<\/a>, votre <span class=\"no-glossary\">propri\u00e9taire<\/span> pourrait changer d&#8217;id\u00e9e et r\u00e9tablir le service.<\/p>\n<p>Si cela ne fonctionne pas, vous pouvez pr\u00e9senter une <span class=\"no-glossary\">requ\u00eate<\/span> \u00e0 la Commission de la <span class=\"no-glossary\">location<\/span> immobili\u00e8re (CLI). La CLI peut ordonner \u00e0 votre <span class=\"no-glossary\">propri\u00e9taire<\/span> de r\u00e9tablir le service. \u00c9tant donn\u00e9 que son ordonnance \u00e9quivaut \u00e0 une ordonnance d&#8217;un tribunal, cela peut fonctionner si les autres moyens n&#8217;ont rien donn\u00e9.<\/p>\n<p>La CLI peut aussi ordonner \u00e0 votre <span class=\"no-glossary\">propri\u00e9taire<\/span> de vous verser un montant d&#8217;argent pour vous d\u00e9dommager des pertes ou des torts qu&#8217;il vous a caus\u00e9s.<\/p>\n<p>Vous devrez faire les d\u00e9marches n\u00e9cessaires si vous voulez que la <span class=\"no-glossary\">CLI <\/span>entende votre <span class=\"no-glossary\">requ\u00eate<\/span> rapidement. Vous devrez aussi pr\u00e9senter des <span class=\"glossary\">preuves<\/span> pour lui d\u00e9montrer qu&#8217;il y a effectivement un probl\u00e8me.<\/p>\n<p>Habituellement, il faut attendre plusieurs semaines ou mois avant que la CLI puisse entendre votre affaire.<\/p>\n<h3>D\u00e9lai<\/h3>\n<p>Si le service a d\u00e9j\u00e0 \u00e9t\u00e9 r\u00e9tabli, vous pouvez faire une <span class=\"no-glossary\">requ\u00eate<\/span> \u00e0 la CLI pour recevoir uniquement un montant d&#8217;argent. Vous ferez mieux de faire cette <span class=\"no-glossary\">requ\u00eate<\/span> <strong>dans l&#8217;ann\u00e9e <\/strong>qui suit la premi\u00e8re coupure de votre service.
