L&#8217;avance doit servir \u00e0 payer votre derni\u00e8re <a class=\"ylr-glossary-term\" rel=\"100129-100251\">p\u00e9riode<\/a> de loyer. Elle ne peut pas \u00eatre utilis\u00e9e pour couvrir des dommages ou d&#8217;autres co\u00fbts.<\/p>\n<p>Cette avance est souvent appel\u00e9e \u00ab\u00a0d\u00e9p\u00f4t de garantie\u00a0\u00bb ou \u00ab\u00a0avance de loyer du dernier mois\u00a0\u00bb.<\/p>\n<p>Le <strong>d\u00e9p\u00f4t pour cl\u00e9s<\/strong> ne peut pas \u00eatre d&#8217;un montant sup\u00e9rieur au co\u00fbt r\u00e9el des cl\u00e9s. Si vous lui rendez les cl\u00e9s quand vous partez, le propri\u00e9taire doit vous rembourser ce d\u00e9p\u00f4t.<\/p>\n<p>Si vous voulez obtenir un jeu de cl\u00e9s suppl\u00e9mentaire, le propri\u00e9taire a le droit de vous en faire payer le co\u00fbt.<\/p>\n<p>Certains b\u00e2timents sont \u00e9quip\u00e9s de serrures \u00e9lectroniques s&#8217;ouvrant avec une carte-cl\u00e9 ou d&#8217;autres dispositifs de ce genre. Les r\u00e8gles restent les m\u00eames que pour les cl\u00e9s.<\/p>\n<h3>D\u00e9p\u00f4ts ill\u00e9gaux<\/h3>\n<p>Il est interdit aux propri\u00e9taires d&#8217;exiger tout autre type de d\u00e9p\u00f4t, notamment\u00a0:<\/p>\n<ul>\n<li>un <a href=\"\/fr\/questions\/housing-law\/un-propri\u00e9taire-peut-il-me-rejeter-parce-que-jai-un-animal-de-compagnie\/\">d\u00e9p\u00f4t pour animal de compagnie<\/a>;<\/li>\n<li>un d\u00e9p\u00f4t en cas de dommages;<\/li>\n<li>tout d\u00e9p\u00f4t dont le montant est sup\u00e9rieur au dernier mois ou \u00e0 la derni\u00e8re semaine de loyer;<\/li>\n<li>des ch\u00e8ques postdat\u00e9s ou tout autre type de paiement pr\u00e9autoris\u00e9;<\/li>\n<li>un d\u00e9p\u00f4t pour cl\u00e9s d&#8217;un montant sup\u00e9rieur au co\u00fbt des cl\u00e9s.<\/li>\n<\/ul>\n<h3>Int\u00e9r\u00eat sur les d\u00e9p\u00f4ts<\/h3>\n<p>Chaque ann\u00e9e, le propri\u00e9taire doit vous payer un int\u00e9r\u00eat sur le montant de vos d\u00e9p\u00f4ts. Cet int\u00e9r\u00eat vous d\u00e9dommage du fait que vous ne pouvez pas d\u00e9penser l&#8217;argent que votre propri\u00e9taire conserve comme d\u00e9p\u00f4t.<\/p>\n<p>Le taux d\u2019int\u00e9r\u00eat est \u00e9gal au <a href=\"\/fr\/questions\/housing-law\/puis-je-accepter-une-augmentation-de-loyer-sup\u00e9rieure-au-taux-l\u00e9gal\/\">taux l\u00e9gal d\u2019augmentation des loyers<\/a> pour l\u2019ann\u00e9e correspondante. Par exemple, si vous avez pay\u00e9 le dernier mois de loyer le 1er ao\u00fbt 2016, le propri\u00e9taire doit vous avoir pay\u00e9 un int\u00e9r\u00eat le 1er ao\u00fbt 2017. Le taux d\u2019int\u00e9r\u00eat est de 1,5 % pour 2017, donc le propri\u00e9taire vous devra 1,5 % d\u2019int\u00e9r\u00eat sur votre d\u00e9p\u00f4t. En 2018, le taux l\u00e9gal est de 1,8 % et votre propri\u00e9taire devra alors vous payer 1,8 % en int\u00e9r\u00eat.<\/p>\n<p>Votre propri\u00e9taire doit payer l&#8217;int\u00e9r\u00eat en vous versant l&#8217;argent ou en l&#8217;additionnant \u00e0 votre d\u00e9p\u00f4t.
