Si votre logement est prot\u00e9g\u00e9 par le taux l\u00e9gal d’augmentation des loyers<\/a> et si votre propri\u00e9taire vous demande d’accepter une augmentation plus forte que ce taux, vous avez le droit de dire non. Vous n’\u00eates pas oblig\u00e9 d’accepter ni de signer quoi que ce soit.<\/p>\n\n\n\n

Si vous refusez cette augmentation, votre propri\u00e9taire peut adresser une requ\u00eate \u00e0 la Commission de la location immobili\u00e8re (CLI) pour qu’elle l’autorise \u00e0 augmenter le loyer de fa\u00e7on plus importante que le taux l\u00e9gal.<\/p>\n\n\n\n

Si vous acceptez cette augmentation, l’entente autorisant une augmentation sup\u00e9rieure au taux l\u00e9gal doit indiquer ce que vous obtenez en retour. Elle doit aussi respecter certaines r\u00e8gles.<\/p>\n\n\n\n

Types d’accords d’augmentation de loyer<\/h3>\n\n\n\n

La loi permet deux cat\u00e9gories d’accord autorisant une augmentation plus importante que le taux l\u00e9gal d’augmentation des loyers.<\/p>\n\n\n\n

Premi\u00e8re cat\u00e9gorie : accord pr\u00e9voyant une augmentation du loyer en \u00e9change d’am\u00e9liorations dans votre logement ou dans le b\u00e2timent. Par exemple, l’accord pourrait stipuler que votre propri\u00e9taire doit remettre \u00e0 neuf vos armoires de cuisine ou vous remplacer votre laveuse et votre s\u00e9cheuse.<\/p>\n\n\n\n

Deuxi\u00e8me cat\u00e9gorie : accord pr\u00e9voyant une augmentation du loyer en \u00e9change de certaines choses qui sont inscrites sur une liste du gouvernement. Cette liste pourrait changer, mais voici quelques exemples de ce qu’elle contient :<\/p>\n\n\n\n

  • Le stationnement;<\/li>\n\n\n\n
  • Le c\u00e2ble ou la t\u00e9l\u00e9vision par satellite;<\/li>\n\n\n\n
  • La climatisation;<\/li>\n\n\n\n
  • L’\u00e9lectricit\u00e9 suppl\u00e9mentaire n\u00e9cessaire \u00e0 l’alimentation d’un climatiseur, d’une laveuse ou d’une s\u00e9cheuse;<\/li>\n\n\n\n
