{"id":1171828,"date":"2019-01-02T13:03:56","date_gmt":"2019-01-02T18:03:56","guid":{"rendered":""},"modified":"2026-01-19T16:47:11","modified_gmt":"2026-01-19T21:47:11","slug":"puis-je-prendre-conge-pour-une-situation-durgence-sans-etre-malade","status":"publish","type":"questions","link":"https:\/\/stepstojustice.ca\/fr\/questions\/employment-and-work\/puis-je-prendre-conge-pour-une-situation-durgence-sans-etre-malade\/","title":{"rendered":"Puis-je prendre cong\u00e9 pour une situation d&#8217;urgence sans \u00eatre malade?"},"content":{"rendered":"<p>Selon la Loi sur les normes d&#8217;emploi (LNE) de l&#8217;Ontario, certains travailleurs peuvent prendre cong\u00e9 dans des situations d&#8217;urgence sans perdre leur emploi.<\/p>\n<p>C&#8217;est ce qu&#8217;on appelle un \u00ab\u00a0cong\u00e9\u00a0\u00bb ou un \u00ab\u00a0cong\u00e9 autoris\u00e9\u00a0\u00bb.<\/p>\n<h3>Types de cong\u00e9s<\/h3>\n<p>Cette question couvre:<\/p>\n<ul>\n<li>le cong\u00e9 de deuil;<\/li>\n<li><span>le cong\u00e9 en cas de violence familiale ou sexuelle;<\/span><\/li>\n<li>le cong\u00e9 en cas de d\u00e9c\u00e8s d&#8217;un enfant;<\/li>\n<li>le cong\u00e9 en cas de disparition d&#8217;un enfant dans des circonstances criminelles;<\/li>\n<li>le cong\u00e9 pour don d&#8217;organe;<\/li>\n<li>le cong\u00e9 de r\u00e9serviste.<\/li>\n<\/ul>\n<p>Vous pourriez aussi prendre un cong\u00e9 pour d&#8217;autres raisons, notamment:<\/p>\n<ul>\n<li>si vous \u00eates malade ou bless\u00e9;<\/li>\n<li>si vous prenez soin d&#8217;un membre de votre famille malade ou bless\u00e9.<\/li>\n<\/ul>\n<h3>R\u00e9mun\u00e9ration<\/h3>\n<p>La LNE pr\u00e9voit que votre employeur doit vous payer, une fois par ann\u00e9e, les 5premiers jours de cong\u00e9 en cas de violence familiale ou sexuelle. L&#8217;\u00e9tape\u00a03 explique les r\u00e8gles de r\u00e9mun\u00e9ration de ce cong\u00e9.<\/p>\n<p>Pour tous les autres cong\u00e9s, votre employeur n&#8217;est pas oblig\u00e9 de vous payer.<\/p>\n<p>Toutefois, vous pourriez avoir droit \u00e0 une r\u00e9mun\u00e9ration si:<\/p>\n<ul>\n<li>vous \u00eates <span>membre d&#8217;un <a href=\"https:\/\/stepstojustice.ca\/fr\/questions\/employment-and-work\/il-y-un-syndicat-ou-je-travaille-quel-effet-cela-t-il-sur\/\">membre d&#8217;un syndicat<\/a>;<\/span><\/li>\n<li>c&#8217;est pr\u00e9vu dans la politique interne de votre lieu de travail ou dans votre <span><a href=\"https:\/\/stepstojustice.ca\/fr\/questions\/employment-and-work\/et-si-lemployeur-veut-que-je-signe-un-contrat\/\">contrat de travail<\/a><\/span>.<\/li>\n<\/ul>\n<p>Vous pourriez aussi recevoir de l&#8217;argent gr\u00e2ce aux programmes destin\u00e9s aux personnes prenant l&#8217;un de ces cong\u00e9s.<\/p>\n<h4>Avantages<\/h4>\n<p>Pendant votre cong\u00e9, votre employeur doit vous offrir les m\u00eames avantages qu&#8217;en p\u00e9riode de travail, par exemple:<\/p>\n<ul>\n<li>r\u00e9gimes de retraite;<\/li>\n<li>r\u00e9gimes d&#8217;assurance-vie;<\/li>\n<li>r\u00e9gimes d&#8217;assurances sant\u00e9 et de soins dentaires.<\/li>\n<\/ul>\n<h3>Retour au travail<\/h3>\n<p>\u00c0 la fin de votre cong\u00e9, votre employeur doit vous redonner votre poste ou vous affecter \u00e0 un poste similaire.\u00a0Vous pourriez toutefois perdre votre emploi pour des raisons non li\u00e9es \u00e0 votre cong\u00e9. Par exemple, si l&#8217;entreprise ferme ses portes.<\/p>\n<h4>Votre salaire<\/h4>\n<p>\u00c0 votre retour, votre employeur doit vous payer le m\u00eame salaire qu&#8217;avant.<\/p>\n<p>Dans le cas
