Demandez au tribunal d&#8217;attribuer un revenu"},"content":{"rendered":"<p>Si vous croyez que votre partenaire dissimule des revenus ou ne gagne pas autant d&#8217;argent qu&#8217;il le pourrait, vous pouvez faire <span class=\"ylr-glossary-term\">appel<\/span> au tribunal pour demander \u00e0 un juge de lui attribuer un revenu \u2013 autrement dit, de d\u00e9terminer qu&#8217;il gagne ou pourrait gagner plus que ce qu&#8217;il d\u00e9clare.<\/p>\n<p>Le juge attribue un revenu \u00e0 votre partenaire en fonction de ce qu&#8217;il pourrait gagner ou gagne v\u00e9ritablement selon lui.<\/p>\n<p>Pour ce faire, il examine&nbsp;:<\/p>\n<ul>\n<li>ses ant\u00e9c\u00e9dents professionnels;<\/li>\n<li>son revenu pass\u00e9;<\/li>\n<li>son \u00e2ge;<\/li>\n<li>ses comp\u00e9tences;<\/li>\n<li>son niveau d&#8217;instruction;<\/li>\n<li>son \u00e9tat de sant\u00e9;<\/li>\n<li>ses possibilit\u00e9s d&#8217;emploi;<\/li>\n<li>son style de vie.<\/li>\n<\/ul>\n<p>Si le juge attribue un revenu \u00e0 votre partenaire, il utilisera le montant attribu\u00e9 pour prendre une d\u00e9cision quant aux pensions alimentaires du conjoint \u00e0 l&#8217;aide des Lignes directrices en mati\u00e8re de pensions alimentaires pour \u00e9poux.<\/p>\n<p>La formule des Lignes directrices permet de calculer des montants bas, moyens et \u00e9lev\u00e9s, ainsi que la p\u00e9riode pendant laquelle les pensions alimentaires seront vers\u00e9es.
