Selon la loi, vous pouvez prouver cette rupture de trois fa\u00e7ons\u00a0:<\/p>\n<ol>\n<li>votre conjoint et vous vivez s\u00e9par\u00e9ment depuis au moins un an;<\/li>\n<li>votre conjoint a commis l&#8217;adult\u00e8re, ce qui signifie qu&#8217;il vous a tromp\u00e9 avec une autre personne \u2013 vous ne pouvez pas demander le divorce pour cause d&#8217;adult\u00e8re si c&#8217;est vous qui avez \u00e9t\u00e9 infid\u00e8le;<\/li>\n<li>votre conjoint a fait preuve d&#8217;une telle cruaut\u00e9 physique ou mentale envers vous que vous ne pouvez plus vivre avec lui.<\/li>\n<\/ol>\n<p>La fa\u00e7on la plus courante de d\u00e9montrer la rupture du mariage est de prouver que votre conjoint et vous <a href=\"\/fr\/questions\/family-law\/comment-puis-je-me-separer-legalement-de-mon-conjoint\/\">vivez s\u00e9par\u00e9ment<\/a>\u00a0depuis <strong>au moins un an.<\/strong> La s\u00e9paration de corps est g\u00e9n\u00e9ralement plus facile \u00e0 prouver que l&#8217;adult\u00e8re ou la cruaut\u00e9.<\/p>\n<p>Au cours de cette p\u00e9riode d&#8217;un an, vous pouvez vivre \u00e0 nouveau avec votre conjoint pendant <strong>au plus 90\u00a0jours<\/strong> pour tenter une r\u00e9conciliation sans que cela influe sur la p\u00e9riode de s\u00e9paration de corps requise. Cette tentative de cette r\u00e9conciliation peut avoir lieu avant ou apr\u00e8s la pr\u00e9sentation d&#8217;une requ\u00eate en divorce.<\/p>\n<p>Vous pouvez demander le divorce d\u00e8s votre s\u00e9paration. Vous n&#8217;avez pas \u00e0 attendre un an.
