Obtenez votre propre conseil juridique ind\u00e9pendant"},"content":{"rendered":"<p>Vous n&#8217;avez pas besoin d&#8217;un avocat pour conclure un accord de s\u00e9paration, mais il est pr\u00e9f\u00e9rable que chacun d&#8217;entre vous obtienne un conseil juridique avant de le signer.<\/p>\n<p>Vous pouvez <a href=\"\/fr\/questions\/family-law\/ou-puis-je-trouver-un-avocat-pour-une-affaire-de-droit-de-la-famille\/\">vous adresser \u00e0 un avocat<\/a>, qui vous aidera \u00e0 comprendre\u00a0:<\/p>\n<ul>\n<li>les r\u00e9clamations que vous pouvez faire apr\u00e8s une s\u00e9paration ou un divorce;<\/li>\n<li>vos droits et vos responsabilit\u00e9s relativement \u00e0 vos enfants et \u00e0 votre conjoint;<\/li>\n<li>les r\u00e8gles \u00e0 suivre;<\/li>\n<li>les changements \u00e0 vos droits qu&#8217;entra\u00eene la signature de l&#8217;accord.<\/li>\n<\/ul>\n<p>Votre conjoint et vous ne devriez pas consulter le m\u00eame avocat. Le conseil est dit ind\u00e9pendant, car chacun des avocats travaille exclusivement pour l&#8217;un d&#8217;entre vous.<\/p>\n<p>Il est important d&#8217;obtenir un conseil juridique ind\u00e9pendant pour les raisons suivantes\u00a0:<\/p>\n<ul>\n<li>vous comprendrez mieux ce que vous acceptez;<\/li>\n<li>votre accord de s\u00e9paration risquera moins d&#8217;\u00eatre contest\u00e9 plus tard devant le tribunal;<\/li>\n<li>le tribunal sera plus port\u00e9 \u00e0 vous ordonner \u00e0 tous deux de respecter l&#8217;accord.<\/li>\n<\/ul>\n<p>Si vous d\u00e9cidez de ne pas obtenir de\u00a0conseil juridique, vous ne pourrez pas vous d\u00e9fendre plus tard en disant que vous ne compreniez pas vos droits reconnus par la loi lorsque vous avez sign\u00e9 l&#8217;accord.<\/p>\n<p>Si vous n&#8217;avez pas les moyens d&#8217;engager un avocat pour la totalit\u00e9 de votre cause, certains avocats offrent des <a href=\"\/fr\/steps\/family-law\/1-pensez-a-ce-dont-vous-avez-besoin-1\/\">services \u00ab\u00a0d\u00e9group\u00e9s\u00a0\u00bb ou \u00ab\u00a0limit\u00e9s\u00a0\u00bb<\/a>.
