Informez-vous sur le Tribunal ICVF"},"content":{"rendered":"<p>Il n\u2019existe qu\u2019un seul <a href=\"https:\/\/stepstojustice.ca\/fr\/resource\/tribunal-int-gr-pour-l-instruction-des-causes-de-violence-familiale\/\" target=\"_blank\" rel=\"noopener\">Tribunal int\u00e9gr\u00e9 pour l\u2019instruction des causes de violence familiale (TIICVF)<\/a>, situ\u00e9 au 10, rue Armoury, \u00e0 Toronto.<\/p>\n<p>Ce tribunal traite les dossiers des familles qui ont des affaires en droit criminel et en droit de la famille impliquant de la <a href=\"https:\/\/stepstojustice.ca\/fr\/questions\/family-law\/comment-savoir-si-je-suis-dans-une-relation-violente\/\">violence conjugale<\/a>. Un seul juge s&#8217;occupe des 2 dossiers.<\/p>\n<p>Vous pourriez \u00eatre admissible au TIICVF si :<\/p>\n<ul>\n<li>votre affaire en droit criminel concerne des infractions sommaires, ce qui signifie que vous risquez une amende maximale de 5 000 $ ou une peine d&#8217;emprisonnement de moins de 2 ans;<\/li>\n<li>votre cause en droit de la famille ne concerne <strong>pas<\/strong> le divorce, le partage des biens ou la protection de l&#8217;enfance;<\/li>\n<li>toutes les parties (le procureur de la Couronne, la personne victime de violence, l&#8217;accus\u00e9 et le juge) acceptent de s&#8217;adresser au TIICVF.<\/li>\n<\/ul>\n<p>Il n&#8217;y a pas de proc\u00e8s au TIICVF, \u00e0 l&#8217;exception de br\u00e8ves audiences en droit de la famille. Les proc\u00e8s plus longs se d\u00e9roulent devant la Cour criminelle ou la Cour de la famille.<\/p>\n<p>Dans les <strong>causes de droit de la famille<\/strong>, le TIICVF peut :<\/p>\n<ul>\n<li>tenir des conf\u00e9rences relatives \u00e0 la cause;<\/li>\n<li>entendre des motions et rendre des ordonnances temporaires;<\/li>\n<li>rendre des ordonnances d\u00e9finitives si les 2 parties sont d&#8217;accord.<\/li>\n<\/ul>\n<p>Dans les <strong>affaires de droit criminel<\/strong>, le tribunal peut :<\/p>\n<ul>\n<li>entendre des demandes de modification des conditions de mise en libert\u00e9 sous caution;<\/li>\n<li>tenir des r\u00e9unions d&#8217;\u00e9tape (rencontres pr\u00e9paratoires au proc\u00e8s);<\/li>\n<li>faire des plaidoyers de culpabilit\u00e9.<\/li>\n<\/ul>\n<p>Les documents en droit de la famille doivent \u00eatre d\u00e9pos\u00e9s en personne au tribunal o\u00f9 l&#8217;affaire a d\u00e9but\u00e9, ou en ligne via le <a href=\"https:\/\/stepstojustice.ca\/fr\/resource\/ontario-courts-public-portal\/\" target=\"_blank\" rel=\"noopener\">Portail public des tribunaux de l&#8217;Ontario<\/a>. Ils ne peuvent pas \u00eatre d\u00e9pos\u00e9s directement au TIICVF.<\/p>\n<p>Les documents de droit criminel peuvent \u00eatre d\u00e9pos\u00e9s \u00e0 la Cour de justice de l&#8217;Ontario, au 10, rue Armoury.
