Vous pouvez inscrire ce que vous \u00eates pr\u00eat \u00e0 accepter dans une offre de r\u00e8glement amiable. Il s&#8217;agit d&#8217;un document \u00e9crit qu&#8217;un des partenaires remet \u00e0 l&#8217;autre pour indiquer ce qu&#8217;il est pr\u00eat \u00e0 accepter afin de r\u00e9soudre une <span class=\"ylr-glossary-term\">partie<\/span> ou la totalit\u00e9 de votre affaire.<\/p>\n<p>Vous pouvez pr\u00e9senter une offre de r\u00e8glement amiable \u00e0 tout moment, m\u00eame si vous n&#8217;avez pas port\u00e9 votre affaire devant les tribunaux. Si vous d\u00e9cidez plus tard de faire appel au tribunal, le juge examinera toutes les offres de r\u00e8glement afin de vous aider \u00e0 conclure une entente avant le proc\u00e8s.<\/p>\n<p>Vous pouvez fixer un <strong>d\u00e9lai<\/strong><strong>.<\/strong> Autrement dit, votre offre peut \u00eatre valide jusqu&#8217;\u00e0 une date et une heure pr\u00e9cises.<\/p>\n<p>Si vous ne fixez pas de d\u00e9lai, votre partenaire peut accepter votre offre tant que le juge n&#8217;a pas tranch\u00e9 vos litiges, et ce, m\u00eame si vous n&#8217;aviez pas encore port\u00e9 votre affaire devant les tribunaux quand vous avez pr\u00e9sent\u00e9 l&#8217;offre.<\/p>\n<p>Vous devez <strong>signer<\/strong> l&#8217;offre de r\u00e8glement amiable. Si vous avez un avocat, il doit \u00e9galement la signer.<\/p>\n<p>Pour mettre fin \u00e0 votre offre de r\u00e8glement amiable, vous devez remettre \u00e0 votre partenaire un avis \u00e9crit indiquant que vous la <strong>retirez<\/strong><strong>.<\/strong> Vous pouvez retirer l&#8217;offre \u00e0 tout moment tant qu&#8217;il ne l&#8217;a pas accept\u00e9e, et ce, que vous ayez fix\u00e9 un d\u00e9lai ou non.<\/p>\n<p>Il est conseill\u00e9 d&#8217;inscrire la mention \u00ab&nbsp;<strong>sous toutes r\u00e9serves<\/strong>&nbsp;\u00bb sur toute offre de r\u00e8glement amiable ou lettre relative au r\u00e8glement envoy\u00e9e \u00e0 votre partenaire. Cette mention indique que le juge de votre proc\u00e8s <strong>ne pourra pas<\/strong> examiner ces documents si vous faites appel au tribunal plus tard. Vous pourrez ainsi pr\u00e9senter une offre de r\u00e8glement amiable sans craindre que le juge qui rend la d\u00e9cision d\u00e9finitive en connaisse le contenu.<\/p>\n<p>Par exemple, durant le proc\u00e8s, vous pourriez demander au tribunal d&#8217;ordonner \u00e0 votre partenaire de payer des aliments pour le conjoint de 500&nbsp;$ par mois pendant 10&nbsp;ans alors que vous \u00e9tiez pr\u00eat \u00e0 accepter moins d&#8217;argent pendant moins de temps dans votre offre de r\u00e8glement amiable.
