D\u00e9terminez pourquoi on vous refuse une mesure d\u2019adaptation"},"content":{"rendered":"<p>Un employeur, propri\u00e9taire, syndicat ou prestataire de services n\u2019est pas forc\u00e9ment oblig\u00e9 de vous offrir de mesure d\u2019adaptation s\u2019il est capable de prouver que cela lui ferait subir un pr\u00e9judice injustifi\u00e9. Il doit tenir compte\u00a0:<\/p>\n<ul>\n<li>du co\u00fbt;<\/li>\n<li>des sources de financement externes;<\/li>\n<li>des risques pour la sant\u00e9 et la s\u00e9curit\u00e9.<\/li>\n<\/ul>\n<p>Il peut y avoir pr\u00e9judice injustifi\u00e9 si la seule solution possible co\u00fbte trop cher ou mettrait en p\u00e9ril la sant\u00e9 ou la s\u00e9curit\u00e9 d\u2019autrui.<\/p>\n<p>Toutefois, un employeur, propri\u00e9taire, syndicat ou prestataire de services ne peut pas se contenter de dire que la solution lui causerait un pr\u00e9judice injustifi\u00e9. Il doit d\u00e9montrer pourquoi la solution est trop ch\u00e8re, pourquoi il n\u2019a pas assez d\u2019argent pour l\u2019adopter ou quels sont les risques pour la sant\u00e9 et la s\u00e9curit\u00e9.<\/p>\n<h3>Co\u00fbts<\/h3>\n<p>Le co\u00fbt de la mesure d\u2019adaptation peut entra\u00eener un pr\u00e9judice injustifi\u00e9 selon la taille de l\u2019organisation. En effet, la mesure peut \u00eatre tout \u00e0 fait convenable pour un gros employeur, mais causer un pr\u00e9judice injustifi\u00e9 \u00e0 un petit employeur. Voici les questions que l\u2019organisation se posera\u00a0:<\/p>\n<ul>\n<li>Pourra-t-on recouvrer les co\u00fbts dans le cours normal des activit\u00e9s?<\/li>\n<li>Est-il possible de diviser le co\u00fbt entre plusieurs secteurs de l\u2019entreprise?<\/li>\n<li>Peut-on r\u00e9partir la d\u00e9pense?<\/li>\n<li>Peut-on utiliser un fonds de r\u00e9serve ou des fonds exc\u00e9dentaires?<\/li>\n<\/ul>\n<p>Si la mesure d\u2019adaptation est trop ch\u00e8re pour l\u2019organisation, celle-ci doit chercher d\u2019autres moyens de la payer, comme une subvention, un programme d\u2019aide ou un pr\u00eat d\u2019un gouvernement ou d\u2019un organisme non gouvernemental.<\/p>\n<h3>Sant\u00e9 et s\u00e9curit\u00e9<\/h3>\n<p>Voici les questions que l\u2019organisation se posera\u00a0:<\/p>\n<ul>\n<li>Est-ce que seul l\u2019employ\u00e9 est \u00e0 risque ou est-ce que d\u2019autres personnes le sont aussi?<\/li>\n<li>La mesure d\u2019adaptation pourrait-elle avoir de graves cons\u00e9quences pour d\u2019autres personnes?
