Parlez \u00e0 des cautions potentielles"},"content":{"rendered":"<h3>Faire renommer une ancienne caution<\/h3>\n<p>Si votre caution d\u00e9cide de se retirer, elle peut d\u00e9cider plus tard de vous cautionner \u00e0 nouveau. Le tribunal n&#8217;en aura pas une mauvaise opinion si elle demande \u00e0 \u00eatre lib\u00e9r\u00e9e de ses fonctions. Cette d\u00e9cision est plut\u00f4t per\u00e7ue comme un signe que la caution est une personne responsable et prend son r\u00f4le au s\u00e9rieux.<\/p>\n<p>Si la Couronne n&#8217;accepte pas que votre ancienne caution reprenne ses fonctions, votre avocat donnera au tribunal des renseignements suppl\u00e9mentaires sur l&#8217;aptitude de la personne \u00e0 vous cautionner.<\/p>\n<p>De plus, votre ancienne caution pourrait devoir t\u00e9moigner sur\u00a0:<\/p>\n<ul>\n<li>sa relation avec vous;<\/li>\n<li>sa capacit\u00e9 \u00e0 vous surveiller;<\/li>\n<li>votre plan de mise en libert\u00e9 sous caution.<\/li>\n<\/ul>\n<p>Si votre ancienne caution ne veut pas reprendre son r\u00f4le, contactez des membres de votre famille ou des amis qui pourraient \u00eatre pr\u00eats \u00e0 vous surveiller pendant votre p\u00e9riode de mise en libert\u00e9. Il est parfois possible de changer de caution sans passer par les tribunaux de cautionnement. C&#8217;est ce qu&#8217;on appelle une \u00ab\u00a0<strong>substitution de caution<\/strong>\u00a0\u00bb. Demandez \u00e0 votre avocat ou \u00e0 l&#8217;avocat de service si vous y \u00eates admissible.<\/p>\n<h3>Pr\u00e9parer un plan de mise en libert\u00e9 sous caution<\/h3>\n<p>Si la Couronne s&#8217;oppose \u00e0 la substitution de votre caution, ou si vous ne trouvez aucun rempla\u00e7ant, vous devrez \u00e0 nouveau compara\u00eetre \u00e0 une audience de mise en libert\u00e9 sous caution.<\/p>\n<p>Avant l&#8217;audience, pr\u00e9parez votre <strong>plan de mise en libert\u00e9 sous caution.<\/strong> Votre avocat vous aidera.<\/p>\n<p>Votre plan doit indiquer comment vous comptez pr\u00e9venir les risques soulev\u00e9s par la Couronne.
