Parfois, les faillis doivent faire des paiements de revenu exc\u00e9dentaire<\/span>. Ces paiements peuvent servir \u00e0 rembourser certains des cr\u00e9anciers et \u00e0 couvrir les frais du syndic.<\/p>\n

La somme \u00e0 payer d\u00e9pend du revenu total de votre m\u00e9nage, ce qui correspond g\u00e9n\u00e9ralement au revenu de votre partenaire plus le v\u00f4tre. La portion \u00ab\u00a0revenu exc\u00e9dentaire\u00a0\u00bb correspond au montant que votre m\u00e9nage gagne en trop par rapport au plafond fix\u00e9 par le gouvernement pour les m\u00e9nages ayant le m\u00eame revenu et le m\u00eame nombre de personnes \u00e0 charge que le v\u00f4tre.<\/p>\n

Le gouvernement fixe le revenu que les faillis et leur famille peuvent garder chaque mois pour vivre. G\u00e9n\u00e9ralement, les paiements de revenu exc\u00e9dentaire correspondent \u00e0 la moiti\u00e9 de la portion du revenu du m\u00e9nage qui exc\u00e8de le montant fix\u00e9.<\/p>\n

Par exemple, en 2015, un m\u00e9nage de trois personnes avait droit \u00e0 3\u00a0156\u00a0$ par mois pour ses frais de subsistance. Si son revenu mensuel \u00e9tait de 3\u00a0500\u00a0$, il gagnait 344\u00a0$ de trop. Il devait donc faire des paiements de revenu exc\u00e9dentaire de 172\u00a0$, soit la moiti\u00e9 de 344\u00a0$.<\/p>\n

Les paiements de revenu exc\u00e9dentaire sont calcul\u00e9s en fonction du revenu du m\u00e9nage et du nombre de personnes qui le compose. Plus un m\u00e9nage compte de membres, plus il peut conserver d’argent. Et plus le revenu de votre m\u00e9nage exc\u00e8de le montant fix\u00e9, plus les paiements de revenu exc\u00e9dentaire seront \u00e9lev\u00e9s.<\/p>\n

Vous pouvez utiliser le calculateur de revenu exc\u00e9dentaire<\/a> (disponible en anglais seulement) pour savoir si votre partenaire devra faire des paiements de revenu exc\u00e9dentaire.
