Examinez la d\u00e9claration de l&#8217;acheteur"},"content":{"rendered":"<p>Lorsqu\u2019il fait sa requ\u00eate pour vous expulser, votre propri\u00e9taire doit pr\u00e9senter \u00e0 la Commission de la location immobili\u00e8re (CLI) un contrat d\u2019achat et de vente sign\u00e9 par lui-m\u00eame et l\u2019acheteur. L\u2019acheteur est \u00e9galement appel\u00e9 l\u2019\u00ab\u00a0acqu\u00e9reur\u00a0\u00bb.<\/p>\n<p>Votre propri\u00e9taire doit \u00e9galement remettre \u00e0 la CLI une d\u00e9claration ou un affidavit sign\u00e9 par la personne qui souhaite emm\u00e9nager dans votre logement locatif. Cette personne peut \u00eatre l\u2019acheteur, un membre de sa famille ou un fournisseur de soins.<\/p>\n<p>Une\u00a0<a href=\"\/fr\/resource\/declaration\/\" target=\"_blank\" rel=\"noopener\">d\u00e9claration<\/a> <span>est une d\u00e9position \u00e9crite et sign\u00e9. Un affidavit est une d\u00e9claration \u00e9crite qui doit \u00eatre sign\u00e9e devant un avocat, un parajuriste ou un notaire public.<\/span><\/p>\n<p>La d\u00e9claration ou l\u2019affidavit doit contenir le nom l\u00e9gal de la personne et indiquer que cette personne compte emm\u00e9nager dans votre logement.<\/p>\n<h3>Obtenir la d\u00e9claration de l\u2019acheteur<\/h3>\n<p>La CLI doit vous envoyer avec la requ\u00eate de votre propri\u00e9taire, une copie de la d\u00e9claration et votre avis d\u2019audience.<\/p>\n<p>Si vous ne recevez pas ces documents, vous pouvez <a href=\"\/fr\/resource\/communiquer-avec-la-cli\/\" target=\"_blank\" rel=\"noopener\">demander \u00e0 la CLI<\/a> de vous envoyer une copie. Ou si vous avez un faible revenu, vous pouvez appeler la <a href=\"\/fr\/resource\/community-legal-clinics\/\" target=\"_blank\" rel=\"noopener\">clinique juridique communautaire<\/a> la plus proche de chez vous pour voir si elle peut vous aider.<\/p>\n<h3>Qui peut s\u2019installer dans votre logement?<\/h3>\n<p>Seules les personnes suivantes peuvent emm\u00e9nager dans votre logement:<\/p>\n<ul>\n<li>l\u2019acheteur;<\/li>\n<li>le conjoint, le p\u00e8re ou la m\u00e8re ou un enfant de l\u2019acheteur;<\/li>\n<li>un beau-parent ou un enfant du conjoint de l\u2019acheteur;<\/li>\n<li>le fournisseur de soins de l\u2019une de ces personnes.<\/li>\n<\/ul>\n<p>Si la personne qui souhaite emm\u00e9nager dans votre logement n\u2019est pas dans cette liste, votre propri\u00e9taire n\u2019a pas le droit de vous expulser.<\/p>\n<p>\u00c0 l\u2019audience, vous pourrez g\u00e9n\u00e9ralement poser des questions au signataire de la d\u00e9claration ou l&#8217;affidavit. Demandez \u00e0 votre propri\u00e9taire par \u00e9crit \u00e0 de ramener cette personne \u00e0 l\u2019audience.<\/p>\n<p>Si vous craignez que le signataire de d\u00e9claration ne vienne pas, vous pouvez demander \u00e0 la CLI de l\u2019assigner \u00e0 compara\u00eetre. La personne sera alors oblig\u00e9e de venir \u00e0 l\u2019audience pour r\u00e9pondre \u00e0 vos questions.
