Rassemblez les \u00e9l\u00e9ments de preuve"},"content":{"rendered":"<p>Vous pourriez ne pas \u00eatre d&#8217;accord avec votre <span class=\"no-glossary\">propri\u00e9taire<\/span> sur l&#8217;origine ou la gravit\u00e9 des dommages caus\u00e9s. Si c&#8217;est le cas, vous devrez, \u00e0 l&#8217;audience, fournir au membre de la Commission de la location immobili\u00e8re (CLI) des <a href=\"\/fr\/questions\/housing-law\/comment-se-deroule-une-audience-dexpulsion\/\">\u00e9l\u00e9ments de preuve<\/a> qui appuient votre version des faits.<\/p>\n<p>Par exemple, votre <span class=\"no-glossary\">propri\u00e9taire<\/span>\u00a0pourrait vous demander de payer pour des dommages qui, en fait, r\u00e9sultent de l&#8217;usure normale (marques sur le plancher parce que les locataires ont march\u00e9 dessus, ou \u00e9caillage de la peinture). Vous pourriez aussi d\u00e9montrer que les dommages ne sont pas aussi graves ou co\u00fbteux que le pr\u00e9tend votre <span class=\"no-glossary\">propri\u00e9taire<\/span>.<\/p>\n<p>Peut-\u00eatre aussi que les dommages \u00e9taient d\u00e9j\u00e0 l\u00e0 quand vous avez emm\u00e9nag\u00e9.<\/p>\n<h3>Obtenez une estimation<\/h3>\n<p>Si vous croyez que la somme demand\u00e9e par le <span class=\"no-glossary\">propri\u00e9taire<\/span> pour les r\u00e9parations est trop \u00e9lev\u00e9e, vous pouvez obtenir votre propre estimation. Il vous suffit de communiquer avec un entrepreneur et de lui demander une estimation \u00e9crite. Envoyez des copies de l&#8217;estimation \u00e0 votre <span class=\"no-glossary\">propri\u00e9taire<\/span> et \u00e0 la CLI au moins <strong>7 jours<\/strong> avant votre audience.<\/p>\n<h3>Prenez des photos<\/h3>\n<p>Si vous croyez que les dommages ne sont pas aussi graves que le pr\u00e9tend le <span class=\"no-glossary\">propri\u00e9taire<\/span>, vous pouvez prendre des photos et les montrer \u00e0 la CLI. Envoyez des copies de l&#8217;estimation \u00e0 votre <span class=\"no-glossary\">propri\u00e9taire<\/span> et \u00e0 la CLI au moins <strong>7 jours<\/strong> avant votre audience.<\/p>\n<h3>Preuve par ou\u00ef-dire (preuve d\u00e9riv\u00e9e)<\/h3>\n<p>Souvent, la <span class=\"no-glossary\">requ\u00eate<\/span> du <span class=\"no-glossary\">propri\u00e9taire<\/span> repose sur les t\u00e9moignages de gens qui n&#8217;assistent pas \u00e0 l&#8217;audience. Vous pouvez demander au membre de la CLI de ne pas accorder trop d&#8217;importance \u00e0 ces t\u00e9moignages, puisqu&#8217;il s&#8217;agit de ou\u00ef-dire.<\/p>\n<p>On appelle ou\u00ef-dire les t\u00e9moignages portant sur les dires d&#8217;autres personnes; le t\u00e9moin n&#8217;a donc rien vu ni entendu. Il s&#8217;agit d&#8217;une preuve d\u00e9riv\u00e9e. Si votre <span class=\"no-glossary\">propri\u00e9taire<\/span>\u00a0affirme qu&#8217;un autre locataire vous a vu causer les dommages, mais que cet autre locataire n&#8217;est pas pr\u00e9sent \u00e0 l&#8217;audience, cette affirmation constitue un ou\u00ef-dire.<\/p>\n<p>La CLI peut admettre des preuves par ou\u00ef-dire, mais vous pouvez faire valoir qu&#8217;elle ne devrait pas ordonner votre <span class=\"glossary\">expulsion<\/span> en se fondant sur de telles preuves.
