Assurez-vous que le propri\u00e9taire a utilis\u00e9 la bonne formule"},"content":{"rendered":"<p>Un propri\u00e9taire\u00a0peut remettre deux avis d&#8217;expulsion \u00e0 un locataire s&#8217;il croit que celui-ci a caus\u00e9 des dommages\u00a0:<\/p>\n<ul>\n<li>la formule\u00a0N5, qui peut \u00eatre annul\u00e9e par le locataire s&#8217;il r\u00e9pare les dommages ou paie pour les r\u00e9parations;<\/li>\n<li>la formule\u00a0N7, qui ne peut pas \u00eatre annul\u00e9e par le locataire.<\/li>\n<\/ul>\n<p>Si votre propri\u00e9taire\u00a0vous remet une formule\u00a0N7, il doit d\u00e9montrer pourquoi la formule\u00a0N5 ne pouvait pas \u00eatre utilis\u00e9e. Il doit prouver que\u00a0:<\/p>\n<ul>\n<li>vous avez caus\u00e9 les dommages intentionnellement (s&#8217;il a coch\u00e9 la case \u00ab\u00a0Motif\u00a02\u00a0\u00bb de la formule);<\/li>\n<li>les dommages caus\u00e9s ou anticip\u00e9s sont graves <strong>et<\/strong> r\u00e9sultent d&#8217;une utilisation du logement incompatible avec son utilisation r\u00e9sidentielle (s&#8217;il a coch\u00e9 la case \u00ab\u00a0Motif\u00a03\u00a0\u00bb de la formule).<\/li>\n<\/ul>\n<p>Si votre propri\u00e9taire n&#8217;est pas en mesure de prouver au moins l&#8217;un de ces \u00e9l\u00e9ments, vous pouvez, \u00e0 l&#8217;audience, faire valoir qu&#8217;il aurait d\u00fb utiliser la formule N5.
