V\u00e9rifiez si votre propri\u00e9taire a d\u00e9pos\u00e9 une requ\u00eate en vue d&#8217;une augmentation plus importante"},"content":{"rendered":"\n<p>Si votre logement est vis\u00e9 par le taux l\u00e9gal et que votre <span class=\"no-glossary\">propri\u00e9taire<\/span> veut augmenter votre loyer d\u2019un pourcentage sup\u00e9rieur \u00e0 ce taux, il doit d\u00e9poser une <span class=\"no-glossary\">requ\u00eate<\/span> aupr\u00e8s de la Commission de la location immobili\u00e8re (CLI).<\/p>\n\n\n\n<p>L\u2019avis d\u2019augmentation de loyer doit \u00eatre donn\u00e9 au moyen de la <a class=\"links-link ext new-link\" href=\"\/fr\/resource\/form-n1-notice-of-rent-increase\/\" target=\"_blank\" rel=\"_blank noopener\">formule N1<\/a>, qui doit pr\u00e9ciser l\u2019un ou l\u2019autre des \u00e9l\u00e9ments suivants :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>le <span class=\"no-glossary\">propri\u00e9taire<\/span> a pr\u00e9sent\u00e9 une <span class=\"ylr-glossary-term\">requ\u00eate<\/span> en vue de l\u2019approbation de l\u2019augmentation;\u00a0<strong>ou<\/strong><\/li>\n\n\n\n<li>la CLI a d\u00e9j\u00e0 approuv\u00e9 l\u2019augmentation.<\/li>\n<\/ul>\n\n\n\n<p>Si le <span class=\"no-glossary\">propri\u00e9taire<\/span> a pr\u00e9sent\u00e9 une <span class=\"ylr-glossary-term\">requ\u00eate<\/span>, vous devriez recevoir un avis distinct \u00e0 cet effet. Vous et les autres locataires concern\u00e9s avez le droit de contester cette <span class=\"ylr-glossary-term\">requ\u00eate<\/span> du <span class=\"no-glossary\">propri\u00e9taire<\/span>.<\/p>\n\n\n\n<p>La CLI peut autoriser une augmentation pour les raisons suivantes, uniquement :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Un ajout de services de s\u00e9curit\u00e9; ou<\/li>\n\n\n\n<li>Certains types de d\u00e9penses en immobilisations;<\/li>\n\n\n\n<li>Des augmentations inhabituellement <a href=\"https:\/\/stepstojustice.ca\/fr\/questions\/housing-law\/mon-proprietaire-peut-il-augmenter-mon-loyer-a-cause-dune-hausse-dimpot\/\">\u00e9lev\u00e9es des taxes et redevances municipales<\/a>.<\/li>\n<\/ul>\n\n\n\n<p>Des d\u00e9penses en immobilisations sont encourues par des r\u00e9parations majeures, des remplacements structurels ou des ajouts qui&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>auront une dur\u00e9e fonctionnelle d\u2019au moins cinq ans; et<\/li>\n\n\n\n<li>ne font pas partie de l\u2019entretien continu normal du logement.<\/li>\n<\/ul>\n\n\n\n<p>Si la CLI a d\u00e9j\u00e0 approuv\u00e9 l\u2019augmentation, vous avez sans doute re\u00e7u :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>un avis concernant la <span class=\"ylr-glossary-term\">requ\u00eate<\/span> du <span class=\"no-glossary\">propri\u00e9taire<\/span>; et<\/li>\n\n\n\n<li>une copie de l\u2019ordonnance d\u2019approbation de la CLI indiquant de combien votre loyer peut augmenter.<\/li>\n<\/ul>\n\n\n\n<p>Si vous n\u2019avez pas re\u00e7u d\u2019avis concernant la <span class=\"ylr-glossary-term\">requ\u00eate<\/span> de votre <span class=\"no-glossary\">propri\u00e9taire<\/span>, communiquez avec la CLI pour savoir si votre <span class=\"no-glossary\">propri\u00e9taire<\/span> a r\u00e9ellement d\u00e9pos\u00e9 une <span class=\"ylr-glossary-term\">requ\u00eate<\/span>.<\/p>\n<!-- AddThis Advanced Settings generic via filter on the_content --><!-- AddThis Share Buttons generic via filter on the_content -->","protected":false},"author":3,"featured_media":0,"template":"","class_list":["post-1177283","steps","type-steps","status-publish","hentry"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v23.9 (Yoast SEO v23.9) - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>3.
