Portez plainte \u00e0 la Commission des relations de travail de l\u2019Ontario"},"content":{"rendered":"<p>Si vous d\u00e9cidez de porter plainte contre votre syndicat \u00e0 la Commission des relations de travail de l\u2019Ontario (la CRTO), <a href=\"\/fr\/questions\/employment-and-work\/o\u00f9-puis-je-obtenir-de-laide-et-des-conseils-relativement-\u00e0-mes-droits\/\" rel=\"noopener\">demandez de l\u2019aide juridique<\/a>.<\/p>\n<p>Les travailleurs syndiqu\u00e9s gagnent rarement leur cause lorsqu\u2019ils portent plainte contre leur syndicat, mais vous aurez de meilleures chances si vous obtenez l\u2019aide d\u2019un avocat qui conna\u00eet bien le processus de requ\u00eates \u00e0 la CRTO.<\/p>\n<h3>Lancement du processus<\/h3>\n<p>Pour entamer le processus, vous devez remplir une <a class=\"links-link ext new-link\" href=\"\/fr\/resource\/requ-te-relative-l-obligation-du-syndicat-d-tre-impartial-dans-son-r-le-de-repr-sentant-formule-a-29\/\" target=\"_blank\" rel=\"noopener\">Requ\u00eate relative \u00e0 l\u2019obligation du syndicat d\u2019\u00eatre impartial dans son r\u00f4le de repr\u00e9sentant (formule\u00a0A-29)<\/a> et un <a class=\"links-link ext new-link\" href=\"\/fr\/resource\/formule-c-14-avis-au-syndicat-et-l-employeur-du-d-p-t-d-une-requ-te-relative-l-obligation-du-syndicat-d-tre-impartial-dans-sons-r-le-de-repr-sentant\/\" target=\"_blank\" rel=\"noopener\">Avis au syndicat et \u00e0 l\u2019employeur du d\u00e9p\u00f4t d\u2019une requ\u00eate relative \u00e0 l\u2019obligation du syndicat d\u2019\u00eatre impartial dans son r\u00f4le de repr\u00e9sentant (formule\u00a0C-14)<\/a>.<\/p>\n<p>Vous devez ensuite donner une copie de ces formules de m\u00eame qu\u2019une copie vierge de la <a class=\"links-link ext new-link\" href=\"\/fr\/resource\/formule-a-30-reponse-intervention-requete-relative-a-lobligation-du-syndicat-detre-impartial-dans-son-role-de-representant\/\" target=\"_blank\" rel=\"noopener\">R\u00e9ponse\/Intervention &#8211; Requ\u00eate relative \u00e0 l&#8217;obligation du syndicat d&#8217;\u00eatre impartial dans sons r\u00f4le de repr\u00e9sentant (formule\u00a0A-30)<\/a> \u00e0 votre employeur et au principal repr\u00e9sentant syndical de votre unit\u00e9 de n\u00e9gociation.<\/p>\n<p>Puis, vous devez remettre vos formules \u00e0 la CRTO. Celle-ci a des <a class=\"links-link ext new-link\" href=\"\/fr\/resource\/proc-dures-de-la-commission-1\/\" target=\"_blank\" rel=\"noopener\">r\u00e8gles<\/a> d\u00e9taill\u00e9es sur ce que vous devez faire, quand et comment. Si vous ne les respectez pas, elle peut refuser d\u2019examiner\u00a0votre requ\u00eate.<\/p>\n<p>La CRTO peut aussi rejeter votre requ\u00eate sans tenir de consultation ni d\u2019audience, si elle juge que cette requ\u00eate ne montre pas que le syndicat a enfreint la loi, m\u00eame si vous d\u00eetes la v\u00e9rit\u00e9.<\/p>\n<h3>Rencontre avec l\u2019agent des relations de travail<\/h3>\n<p>Une fois que la CRTO a re\u00e7u votre requ\u00eate, un agent des relations de travail organise normalement une rencontre avec vous et votre syndicat pour voir si vous pouvez vous entendre sur une solution. Parfois, il rencontre aussi l\u2019employeur.<\/p>\n<h3>Consultation<\/h3>\n<p>Si vous ne pouvez pas vous entendre avec votre syndicat, la prochaine \u00e9tape prend souvent la forme d\u2019une consultation, o\u00f9 le vice-pr\u00e9sident de la CRTO vous pose des questions.<\/p>\n<p>Les gens ne pr\u00e9sentent g\u00e9n\u00e9ralement pas de t\u00e9moins \u00e0 la consultation, mais si vous avez des documents qui peuvent vous aider \u00e0 prouver ce qui s\u2019est pass\u00e9, amenez-les.<\/p>\n<p>Le vice-pr\u00e9sident rend ensuite sa d\u00e9cision sur votre requ\u00eate.
