Parlez \u00e0 un m\u00e9diateur"},"content":{"rendered":"<p>La Commission des relations de travail de l\u2019Ontario (la CRTO) confirmera par \u00e9crit qu\u2019elle a re\u00e7u votre requ\u00eate.<\/p>\n<p>Elle affectera un m\u00e9diateur \u00e0 votre requ\u00eate. Les m\u00e9diateurs sont parfois appel\u00e9s agents des relations de travail (ART).<\/p>\n<p>Le m\u00e9diateur communiquera avec vous et votre employeur pour essayer de vous aider \u00e0 trouver un terrain d\u2019entente. Si vous parvenez \u00e0 vous entendre, la tenue d\u2019une audience ne sera pas n\u00e9cessaire.<\/p>\n<p>L\u2019audience est une proc\u00e9dure qui peut \u00eatre dispendieuse et complexe.<\/p>\n<h3>Collaborez avec un m\u00e9diateur<\/h3>\n<p>Le m\u00e9diateur est neutre, donc il ne repr\u00e9sente ni vous ni votre employeur.<\/p>\n<p>Le m\u00e9diateur peut vous donner de l\u2019information suppl\u00e9mentaire sur la loi et vous aider \u00e0 comprendre l\u2019\u00e9ventuelle d\u00e9cision de la CRTO, en cas d\u2019audience. Il ne peut pas vous obliger \u00e0 faire ou accepter quoi que ce soit.<\/p>\n<p>Le m\u00e9diateur pourrait organiser une rencontre avec vous et votre employeur, ou vous poser des questions au t\u00e9l\u00e9phone. Vous devez lui expliquer la situation et lui montrer vos \u00e9l\u00e9ments de preuve.<\/p>\n<p>Il pourrait discuter avec vous et votre employeur \u00e0 plusieurs reprises pour voir si vous pouvez trouver une solution qui vous convient \u00e0 tous les deux.<\/p>\n<p>Le m\u00e9diateur ne prend aucune d\u00e9cision d\u00e9finitive concernant votre plainte, si vous ne parvenez pas \u00e0 vous entendre avec votre employeur.<\/p>\n<p>Vous pouvez discuter franchement avec le m\u00e9diateur. Tout ce dont vous parlez en m\u00e9diation est confidentiel et ne peut g\u00e9n\u00e9ralement pas \u00eatre utilis\u00e9 par votre employeur lors de l&#8217;audience. Le vice-pr\u00e9sident est la personne en charge de votre audience. Le vice-pr\u00e9sident n&#8217;est pas inform\u00e9 de ce dont vous et votre employeur avez discut\u00e9 lors de la m\u00e9diation.<\/p>\n<p>La CRTO pr\u00e9cise au m\u00e9diateur la date limite \u00e0 laquelle il doit lui indiquer si vous et votre employeur vous \u00eates entendus sur une solution. Si vous vous entendez, c\u2019est ce qu\u2019on appelle \u00ab parvenir \u00e0 un r\u00e8glement \u00bb. Si vous ne le faites pas, la CRTO organisera une consultation ou une audience.<\/p>\n<p>Vous recevrez par la poste un avis indiquant la date et l&#8217;heure de la consultation ou de l\u2019audience.
