Pr\u00e9parez-vous \u00e0 l\u2019audience"},"content":{"rendered":"<p>La Commission des relations de travail de l&#8217;Ontario (CRTO) vous enverra un avis d\u2019audience qui pr\u00e9cisera la date, l\u2019heure et le lieu de l\u2019audience.<\/p>\n<h3>Rassemblez les \u00e9l\u00e9ments de preuve<\/h3>\n<p>\u00c0 l\u2019audience, la CRTO utilise des preuves pour prendre une d\u00e9cision concernant votre requ\u00eate. Les renseignements inclus dans votre requ\u00eate <strong>ne constituent pas<\/strong> des \u00e9l\u00e9ments de preuve.<\/p>\n<p>Vous devez avoir des preuves \u00e0 votre audience pour prouver:<\/p>\n<ul>\n<li>que par sa fa\u00e7on d\u2019agir, votre employeur a port\u00e9 atteinte \u00e0 vos droits pr\u00e9vus dans la Loi sur les normes d\u2019emploi; <strong>et<\/strong><\/li>\n<li>qu\u2019en raison de ce comportement, vous avez perdu de l\u2019argent ou \u00e9t\u00e9 l\u00e9s\u00e9 d\u2019une autre mani\u00e8re.<\/li>\n<\/ul>\n<p>Cette preuve peut prendre les formes suivantes\u00a0:<\/p>\n<ul>\n<li>votre t\u00e9moignage;<\/li>\n<li>t\u00e9moignages de personnes qui racontent ce qu\u2019elles savent des \u00e9v\u00e9nements ou expliquent les r\u00e9percussions de ceux-ci sur votre vie;<\/li>\n<li>documents (p.\u00a0ex., lettres ou courriels) provenant de l\u2019employeur.<\/li>\n<\/ul>\n<p>Les \u00e9l\u00e9ments de preuve que vous choisissez de pr\u00e9senter peuvent \u00e9galement prendre d\u2019autres formes. Il peut notamment s\u2019agir de photos, de vid\u00e9os ou d\u2019enregistrements audio qui vous aideront \u00e0 \u00e9tablir le bien-fond\u00e9 de votre requ\u00eate. La personne qui a pris la photo ou fait l\u2019enregistrement doit compara\u00eetre \u00e0 l\u2019audience.<\/p>\n<h3>Respectez les r\u00e8gles relatives \u00e0 la preuve<\/h3>\n<p>La CRTO dispose de <a class=\"links-link ext new-link\" href=\"\/fr\/resource\/r-gles-de-proc-dure-de-la-commission-des-relations-de-travail-de-l-ontario\/\" target=\"_blank\" rel=\"noopener\">r\u00e8gles<\/a> pr\u00e9cises concernant la preuve. Si vous ne suivez pas ces r\u00e8gles, la CRTO peut refuser de tenir compte de votre preuve ou rejeter votre requ\u00eate sans audience.<\/p>\n<p>Par exemple, une r\u00e8gle est que vous devez remettre des copies de toutes vos preuves \u00e0 votre employeur, \u00e0 la CRTO et \u00e0 toute autre personne impliqu\u00e9e dans l&#8217;audience au moins 10 jours avant la date de votre audience ou de votre consultation.<\/p>\n<p>Une autre r\u00e8gle est que vous devez inclure une table des mati\u00e8res qui d\u00e9crit bri\u00e8vement chaque \u00e9l\u00e9ment de preuve, et vous devez num\u00e9roter chaque page de vos documents.<\/p>\n<h3>D\u00e9cision<\/h3>\n<p>En g\u00e9n\u00e9ral, la CRTO rend sa d\u00e9cision apr\u00e8s l\u2019audience. Elle vous enverra une copie \u00e9crite de celle-ci par la poste.<\/p>\n<p>Cette d\u00e9cision est g\u00e9n\u00e9ralement d\u00e9finitive.
