Remplissez votre requ\u00eate pour la CRTO"},"content":{"rendered":"<p>Cette requ\u00eate est parfois appel\u00e9e une \u00ab\u00a0plainte en vertu de l\u2019article\u00a050\u00a0\u00bb parce que c\u2019est cet article de la Loi sur la sant\u00e9 et la s\u00e9curit\u00e9 au travail qui pr\u00e9cise que votre employeur ne peut exercer des repr\u00e9sailles illicites contre vous.<\/p>\n<p>Pour d\u00e9poser une plainte pour repr\u00e9sailles ill\u00e9gales aupr\u00e8s de la Commission des relations de travail de l&#8217;Ontario (CRTO), vous devez remplir les formulaires suivants :<\/p>\n<ul>\n<li><a class=\"links-link ext new-link\" href=\"\/fr\/resource\/appointment-of-agent-by-owners-in-territority-without-municipal-organization-to-arrange-road-work-with-the-minister-of-transportation-1\/\" target=\"_blank\" rel=\"noopener\">Formulaire A-53 : Requ\u00eate en vertu de l\u2019article 50 de la Loi<\/a>.<\/li>\n<li><a class=\"links-link ext new-link\" href=\"\/fr\/resource\/formule-c-26-avis-l-employeur-et-ou-toute-partie-touch-e-du-d-p-t-d-une-requ-te-en-vertu-de-l-article-50-de-la-loi-repr-sailles-illicites-loi-sur-la-sant-et-la-s-curit-au-travail\/\" target=\"_blank\" rel=\"noopener\">Formulaire C-26 : Avis \u00e0 l\u2019employeur et\/ou \u00e0 toute partie touch\u00e9e du d\u00e9p\u00f4t d\u2019une requ\u00eate ou d\u2019un renvoi en vertu de l\u2019article 50 de la Loi<\/a>.<\/li>\n<\/ul>\n<h3>Remplissez le formulaire A-53<\/h3>\n<p>Dans le formulaire A-53, vous devriez expliquer en d\u00e9tail ce qui s\u2019est pass\u00e9 et les recours demand\u00e9s \u00e0 la CRTO.<\/p>\n<p>Vous devez inclure les renseignements suivants :<\/p>\n<ul>\n<li>vos nom, adresse, num\u00e9ro de t\u00e9l\u00e9phone et adresse de courriel;<\/li>\n<li>les nom, adresse, num\u00e9ro de t\u00e9l\u00e9phone et adresse de courriel de votre employeur;<\/li>\n<li>une description d\u00e9taill\u00e9e de ce qui s\u2019est pass\u00e9, y compris les dates, les lieux et le nom des personnes concern\u00e9es;<\/li>\n<li>les dispositions de la LSST qui n\u2019ont pas \u00e9t\u00e9 respect\u00e9es par l&#8217;employeur;<\/li>\n<li>une description d\u00e9taill\u00e9e des recours demand\u00e9s \u00e0 la CRTO.<\/li>\n<\/ul>\n<p>Dans la description de ce qui s\u2019est pass\u00e9, vous devez pr\u00e9ciser ce qui suit\u00a0:<\/p>\n<ul>\n<li>chaque \u00e9v\u00e9nement d\u2019importance, selon vous;<\/li>\n<li>date de chacun de ces \u00e9v\u00e9nements;<\/li>\n<li>lieu de chacun de ces \u00e9v\u00e9nements;<\/li>\n<li>personnes pr\u00e9sentes;<\/li>\n<li>blessures subies, rendez-vous m\u00e9dicaux ou discussions avec d\u2019autres sp\u00e9cialistes.<\/li>\n<\/ul>\n<p>Vous n\u2019avez pas \u00e0 employer de la terminologie juridique, et si vous le faites, mais que vous vous trompez, cela pourrait vous nuire plus tard. Il est pr\u00e9f\u00e9rable d&#8217;expliquer seulement ce qui s\u2019est pass\u00e9, dans vos propres mots.<\/p>\n<p>Vous devez pr\u00e9ciser \u00e0 la CRTO ce que vous aimeriez qu&#8217;elle fasse, par exemple, vous voudriez :<\/p>\n<ul>\n<li>la modification de la politique de sant\u00e9 et de s\u00e9curit\u00e9 de l\u2019employeur;<\/li>\n<li>le r\u00e8glement, par l\u2019employeur, d\u2019un probl\u00e8me de sant\u00e9 et de s\u00e9curit\u00e9;<\/li>\n<li>l&#8217;annulation d\u2019une suspension ou d\u2019une autre mesure disciplinaire;<\/li>\n<li>\u00eatre r\u00e9embauch\u00e9 par votre employeur;<\/li>\n<li>le versement, par l\u2019employeur, d\u2019une <a href=\"\/fr\/questions\/employment-and-work\/jai-ete-congedie-a-combien-de-jours-de-preavis-ai-je-droit\/\">indemnit\u00e9 en cas de perte de salaire ou de perte d\u2019emploi.<\/a><\/li>\n<\/ul>\n<p>Vous pouvez \u00e9galement sugg\u00e9rer autre chose qui r\u00e9glera votre probl\u00e8me.<\/p>\n<p>Il est important de bien consigner tous les renseignements dans le formulaire A-53.
