{"id":1177787,"date":"2018-02-27T11:35:53","date_gmt":"2018-02-27T16:35:53","guid":{"rendered":""},"modified":"2022-02-15T15:32:00","modified_gmt":"2022-02-15T20:32:00","slug":"beaux-parents","status":"publish","type":"steps","link":"https:\/\/stepstojustice.ca\/fr\/steps\/family-law\/beaux-parents\/","title":{"rendered":"Beaux-parents"},"content":{"rendered":"<p>Selon la loi, les beaux-parents doivent parfois payer des pensions alimentaires pour\u00a0enfants qui sont des \u00ab\u00a0enfants \u00e0 charge\u00a0\u00bb qu&#8217;ils traitent comme des membres de leur propre famille.<\/p>\n<p>Le tribunal examine notamment les facteurs suivants pour d\u00e9terminer si le beau-parent a une relation s&#8217;apparentant \u00e0 celle d&#8217;un parent avec l&#8217;enfant de son conjoint\u00a0:<\/p>\n<ul>\n<li>Quelle opinion l&#8217;enfant a-t-il de sa relation avec le beau-parent?<\/li>\n<li>L&#8217;enfant fait-il <span class=\"ylr-glossary-term\">partie<\/span> de la famille \u00e9largie au m\u00eame titre qu&#8217;un enfant biologique?<\/li>\n<li>Le beau-parent fait-il de son mieux pour subvenir aux besoins de l&#8217;enfant?<\/li>\n<li>Le beau-parent \u00e9duque-t-il l&#8217;enfant?<\/li>\n<li>Le beau-parent se d\u00e9crit-il comme un parent responsable lorsqu&#8217;il s&#8217;adresse \u00e0 l&#8217;enfant, \u00e0 la famille et aux autres personnes?<\/li>\n<li>Quelle est la relation de l&#8217;enfant avec son parent biologique absent?<\/li>\n<\/ul>\n<p>Le fait que les partenaires soient <span class=\"glossary\" term=\"1179911\">mari\u00e9s<\/span> ou <span class=\"glossary\" term=\"1179766\">conjoints de fait<\/span> n&#8217;a aucune incidence.<\/p>\n<p>Les beaux-parents peuvent payer des pensions alimentaires pour\u00a0enfants m\u00eame si le parent biologique absent en paie d\u00e9j\u00e0. Autrement dit, plus d&#8217;un parent peut \u00eatre l\u00e9galement tenu de payer des pensions alimentaires pour un m\u00eame enfant.<\/p>\n<p>Toutefois, le tribunal peut ordonner au beau-parent de <a href=\"\/fr\/questions\/family-law\/a-combien-selevent-les-pensions-alimentaires-pour-enfants\/\">payer un montant<\/a> diff\u00e9rent de celui des Lignes directrices sur les pensions alimentaires pour\u00a0enfants et des <a class=\"links-link ext new-link\" href=\"\/fr\/resource\/child-support-table-look-up\/\" target=\"_blank\" rel=\"noopener\">tables de pensions alimentaires pour enfants<\/a> du gouvernement du Canada.<\/p>\n<p>Pour \u00e9tablir le montant que le beau-parent doit payer, certains juges prennent le montant de la table et en d\u00e9duisent le montant des pensions alimentaires vers\u00e9es par le parent biologique. D&#8217;autres ordonnent au beau-parent de payer le montant de la table au complet.
