D\u00e9terminez si vous avez besoin d\u2019une premi\u00e8re comparution"},"content":{"rendered":"<p>Il existe 2 situations dans lesquelles vous n&#8217;avez peut-\u00eatre pas besoin de vous rendre \u00e0 une premi\u00e8re comparution ou de rencontrer un agent de r\u00e8glement des diff\u00e9rends (ARD)\u00a0:<\/p>\n<h3>M\u00e9diation familiale<\/h3>\n<p>En mars 2021, de nouvelles r\u00e8gles sont entr\u00e9es en vigueur pour encourager le recours aux modes de\u00a0r\u00e8glement extrajudiciaire des diff\u00e9rends\u00a0(RED) ou aux processus de r\u00e8glement des diff\u00e9rends familiaux. Ces r\u00e8gles indiquent que vous et votre partenaire\u00a0<strong>devez<\/strong>\u00a0penser \u00e0 recourir au\u00a0RED ou\u00a0processus de r\u00e8glement des diff\u00e9rends familiaux\u00a0pour r\u00e9soudre vos probl\u00e8mes\u00a0<a href=\"\/fr\/questions\/family-law\/pouvons-nous-r\u00e9soudre-nos-litiges-sans-faire-appel-au-tribunal-0\/\">\u00e0 l\u2019amiable<\/a>,\u00a0si cela vous convient.\u00a0Le\u00a0RED pourrait ne pas vous convenir si:<\/p>\n<ul>\n<li>une personne a peur d&#8217;une autre\u00a0parce qu&#8217;elle a des ant\u00e9c\u00e9dents de\u00a0<a href=\"\/fr\/questions\/family-law\/comment-savoir-si-je-suis-dans-une-relation-violente\/\">violence conjugale<\/a><\/li>\n<li>il y a de graves probl\u00e8mes de sant\u00e9 mentale ou de toxicomanie<\/li>\n<\/ul>\n<p>Le RED est\u00a0<strong>volontaire<\/strong>. Ainsi, m\u00eame si vous devez penser \u00e0 vous y pr\u00eater; on ne peut pas vous forcer \u00e0 y avoir recours.<\/p>\n<p>Vous pouvez recourir au RED avant d&#8217;aller au tribunal ou \u00e0 tout moment apr\u00e8s le d\u00e9but d&#8217;une affaire judiciaire. Chaque tribunal de la famille en Ontario offre des\u00a0<a href=\"\/fr\/resource\/des-services-d-information-et-de-m-diation\/\" target=\"_blank\" rel=\"noopener\">services de m\u00e9diation subventionn\u00e9s<\/a>.<\/p>\n<p>\u00c0 compter du 1er ao\u00fbt 2021, si vous et votre partenaire avez essay\u00e9 la\u00a0<strong><a href=\"https:\/\/stepstojustice.ca\/fr\/questions\/family-law\/quest-ce-que-la-m%C3%A9diation\/\">m\u00e9diation\u00a0familiale<\/a><\/strong>, un juge peut vous autoriser \u00e0 passer directement \u00e0 une\u00a0conf\u00e9rence relative \u00e0 la cause\u00a0et \u00e0 une\u00a0conf\u00e9rence en vue d&#8217;un r\u00e8glement amiable\u00a0combin\u00e9es. Pour plus d&#8217;informations, lire la question \u00ab <a href=\"\/fr\/questions\/family-law\/quest-ce-que-la-conference-relative-a-la-cause-en-droit-de-la-famille-et\/\">Qu&#8217;est-ce que la conf\u00e9rence relative \u00e0 la cause en droit de la famille et comment se d\u00e9roule-t-elle?<\/a>\u00bb.<\/p>\n<p>Si vous avez tent\u00e9 la m\u00e9diation familiale et le juge n&#8217;a pas combin\u00e9 les conf\u00e9rences ou autoris\u00e9 \u00e0 passer la premi\u00e8re comparution ou rencontre avec l\u2019ADR, vous ou votre partenaire pouvez le demander en pr\u00e9sentant une\u00a0<a href=\"\/fr\/resource\/formule-14b-formule-de-motion\/\" target=\"_blank\" rel=\"noopener\">Formule 14B : Formule de motion<\/a>.<\/p>\n<h3>Niveau des tribunaux de la famille<\/h3>\n<p>En Ontario, les 3 tribunaux suivants s&#8217;occupent des affaires de droit de la famille\u00a0:<\/p>\n<ul>\n<li>la Cour de justice de l&#8217;Ontario;<\/li>\n<li>la Cour sup\u00e9rieure de justice;<\/li>\n<li>la division de la Cour de la famille de la Cour sup\u00e9rieure de justice.<\/li>\n<\/ul>\n<p>Il y a une premi\u00e8re comparution si votre affaire est entendue par\u00a0:<\/p>\n<ul>\n<li>la Cour de justice de l&#8217;Ontario;<\/li>\n<li>la division de la Cour de la famille de la Cour sup\u00e9rieure de justice, \u00e0 moins qu&#8217;il y ait une demande de\u00a0divorce\u00a0ou de partage de biens.<\/li>\n<\/ul>\n<p>Il n&#8217;y a pas de premi\u00e8re comparution dans les affaires entendues par la Cour sup\u00e9rieure de justice.<\/p>\n<h3>Aucune premi\u00e8re comparution<\/h3>\n<p>Si vous n&#8217;avez pas de premi\u00e8re comparution et vous n\u2019avez pas tent\u00e9 la m\u00e9diation familiale, votre partenaire ou vous-m\u00eame devez demander au greffier du tribunal de fixer la date d&#8217;une conf\u00e9rence relative \u00e0 la cause pour que votre affaire puisse aller de l&#8217;avant. Si vous \u00eates le requ\u00e9rant, la date de la premi\u00e8re comparution vous a \u00e9t\u00e9 indiqu\u00e9e \u00e0 la remise de votre requ\u00eate aupr\u00e8s du greffier du tribunal. Consultez la premi\u00e8re page de votre requ\u00eate.<\/p>\n<p>Si vous \u00eates l&#8217;intim\u00e9, cette date devrait \u00eatre indiqu\u00e9e dans les documents que votre partenaire vous a signifi\u00e9s.
