La personne \u00e0 qui vous sous-louez votre logement s&#8217;appelle le \u00ab\u00a0sous-locataire\u00a0\u00bb.<\/p>\n<p>Vous ne pouvez pas lui demander un loyer plus \u00e9lev\u00e9 que ce que vous payez \u00e0 votre propri\u00e9taire.<\/p>\n<p>Choisissez votre sous-locataire judicieusement. Si la personne cause des dommages ou ne paie pas, vous devrez peut-\u00eatre payer de votre poche.<\/p>\n<h3>Entente de sous-location<\/h3>\n<p>Vous devez conclure une entente avec votre sous-locataire. Celle-ci doit prendre fin \u00e0 une date pr\u00e9cise, soit\u00a0:<\/p>\n<ul>\n<li>le jour <strong>pr\u00e9c\u00e9dant<\/strong> la date o\u00f9 prend fin votre bail (et non le jour m\u00eame), si vous avez une location \u00e0 terme fixe;<\/li>\n<li>le jour <strong>pr\u00e9c\u00e9dant<\/strong> la derni\u00e8re journ\u00e9e d&#8217;une p\u00e9riode de location (et non le jour m\u00eame), si vous n&#8217;avez pas une location \u00e0 terme fixe.<\/li>\n<\/ul>\n<p>Il est pr\u00e9f\u00e9rable de faire cette entente par \u00e9crit. Mais pour refuser votre demande, il doit avoir une raison valable. Par exemple, si cette personne a d\u00e9j\u00e0 caus\u00e9 des probl\u00e8mes \u00e0 un autre propri\u00e9taire\u00a0parce qu&#8217;elle a endommag\u00e9 le logement ou n&#8217;a pas pay\u00e9 son loyer.<\/p>\n<p>Si votre propri\u00e9taire\u00a0accepte votre demande, il peut exiger des frais. Ceux-ci ne peuvent toutefois pas \u00eatre sup\u00e9rieurs au montant qu&#8217;il a d\u00fb d\u00e9bourser pour faire une v\u00e9rification du cr\u00e9dit ou afficher le logement, par exemple, si c&#8217;est lui qui a trouv\u00e9 le nouveau locataire.<\/p>\n<h3>Si votre propri\u00e9taire\u00a0refuse votre demande<\/h3>\n<p>Si votre propri\u00e9taire refuse que vous sous-louiez votre logement, vous pouvez pr\u00e9senter une requ\u00eate \u00e0 la Commission de la location immobili\u00e8re (CLI) pour avoir l&#8217;autorisation de le faire ou de mettre fin \u00e0 votre contrat de location.
