Si vous croyez avoir un bon motif de rester, vous pouvez d\u00e9cider de contester l\u2019avis. Cela signifie, en g\u00e9n\u00e9ral, qu\u2019il y aura une audience \u00e0 la Commission de la location immobili\u00e8re (CLI).<\/p>\n<h3>Raisons de contester l\u2019avis d\u2019expulsion<\/h3>\n<p>Vous pourriez d\u00e9cider de contester l\u2019avis si :<\/p>\n<ul>\n<li>vous croyez que votre propri\u00e9taire n\u2019effectuera pas les travaux indiqu\u00e9s;<\/li>\n<li>les travaux peuvent \u00eatre r\u00e9alis\u00e9s sans que vous ayez \u00e0 d\u00e9m\u00e9nager;<\/li>\n<li>votre propri\u00e9taire ne pourra pas obtenir un permis de construire;<\/li>\n<li>les travaux que votre propri\u00e9taire\u00a0veut effectuer ne requi\u00e8rent pas un permis de construire;<\/li>\n<li>votre propri\u00e9taire ne pourra pas obtenir un permis\u00a0de construire;<\/li>\n<li>votre propri\u00e9taire ne vous a pas vers\u00e9 l\u2019indemnisation qu\u2019il devait vous pay\u00e9.<\/li>\n<\/ul>\n<p>Vous pouvez aussi contester l\u2019avis s\u2019il n\u2019est pas conforme aux r\u00e8gles. Voici des exemples\u00a0:<\/p>\n<ul>\n<li>votre propri\u00e9taire vous a remis l\u2019avis moins de 120\u00a0jours avant la date pr\u00e9vue pour votre d\u00e9m\u00e9nagement.<\/li>\n<li>L\u2019avis ne contient pas toute l\u2019information demand\u00e9e dans la\u00a0<a href=\"\/fr\/resource\/formulaire-n13-avis-de-r-siliation-de-la-location-parce-que-le-locateur-veut-d-molir-le-logement-locatif-y-effectuer-des-r-parations-ou-l-affecter-un-autre-usage\/\" target=\"_blank\">Formule\u00a0N13<\/a>.<\/li>\n<\/ul>\n<h3>Audience d\u2019expulsion<\/h3>\n<p>Si vous ne d\u00e9m\u00e9nagez pas, votre propri\u00e9taire doit d\u00e9posez une requ\u00eate \u00e0 la CLI pour rendre une ordonnance d\u2019expulsion. Il devra prouver \u00e0 l\u2019<a href=\"\/fr\/questions\/housing-law\/comment-se-deroule-une-audience-dexpulsion\/\">audience devant la CLI<\/a>, il qu\u2019il a respect\u00e9 la loi et qu\u2019il a un motif l\u00e9gal pour vous demander de d\u00e9m\u00e9nager.<\/p>\n<p>Vous avez le droit de contester l\u2019avis d\u2019expulsion lors de l\u2019audience et d\u2019expliquer \u00e0 la CLI pourquoi vous ne devriez pas \u00eatre expuls\u00e9.<\/p>\n<p>Vous devez vous <a href=\"\/fr\/questions\/housing-law\/comment-dois-je-me-preparer-a-une-audience-dexpulsion\/\">pr\u00e9parer \u00e0 l\u2019audience<\/a>.
