Savoir d\u00e9poser une plainte officielle"},"content":{"rendered":"<p>Si votre plainte ne convient pas \u00e0 la r\u00e9solution locale, ou si vous pr\u00e9f\u00e9rez d\u00e9poser imm\u00e9diatement une <strong>plainte officielle<\/strong>, vous devez remplir le formulaire de plainte de l&#8217;Agence des plaintes contre les forces de l&#8217;ordre (APFO).<\/p>\n<p>L&#8217;APFO n&#8217;accepte que les plaintes officielles contre\u00a0:<\/p>\n<ul>\n<li>un agent de police d&#8217;un service municipal ou r\u00e9gional, ou de la Police provinciale de l&#8217;Ontario (Police provinciale);<\/li>\n<li>un constable sp\u00e9cial de la Commission des parcs du Niagara;<\/li>\n<li>un agent de la paix du Service de protection de l&#8217;Assembl\u00e9e l\u00e9gislative;<\/li>\n<li>un agent de police d&#8217;une Premi\u00e8re Nation si son service se conforme \u00e0 la Loi sur la s\u00e9curit\u00e9 communautaire et les services policiers.<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\"><\/li>\n<\/ul>\n<h3>Date limite<\/h3>\n<p>Vous avez <strong>6 mois<\/strong> apr\u00e8s l&#8217;incident pour porter plainte aupr\u00e8s de l&#8217;APFO. Pass\u00e9 ce d\u00e9lai, vous devrez expliquer le retard.<\/p>\n<p>L&#8217;APFO peut accepter les plaintes tardives <a href=\"\/fr\/resource\/lapfo-examen-preliminaire-des-plaintes\/\" target=\"_blank\" rel=\"noopener\">dans certains cas<\/a>.<\/p>\n<h3>Processus<\/h3>\n<p>L&#8217;APFO peut rejeter les plaintes\u00a0:<\/p>\n<ul>\n<li>ne portant pas sur le comportement d&#8217;un policier;<\/li>\n<li>peu importantes ou semblant fausses;<\/li>\n<li>ne servant pas l&#8217;int\u00e9r\u00eat public;<\/li>\n<li>d\u00e9pos\u00e9es plus de 6 mois apr\u00e8s l&#8217;incident;<\/li>\n<li>relevant d&#8217;une autre loi.<\/li>\n<\/ul>\n<p>Si l&#8217;APFO accepte une plainte, elle d\u00e9cide de la proc\u00e9dure\u00a0:<\/p>\n<ul>\n<li><a href=\"\/fr\/resource\/lapfo-le-programme-de-reglement-anticipe\/\" target=\"_blank\" rel=\"noopener\">r\u00e8glement anticip\u00e9<\/a>, <a href=\"\/fr\/resource\/lapfo-informal-resolution\/\">r\u00e8glement informel<\/a> ou <a href=\"\/fr\/resource\/lapfo-mediation\/\" target=\"_blank\" rel=\"noopener\">m\u00e9diation<\/a>,<\/li>\n<li>enqu\u00eate plus pouss\u00e9e.<\/li>\n<\/ul>\n<p>Pour en savoir plus sur le r\u00e8glement anticip\u00e9, le r\u00e8glement informel et la m\u00e9diation, voir l&#8217;\u00e9tape\u00a04.<\/p>\n<p>Si une enqu\u00eate est n\u00e9cessaire, c&#8217;est habituellement <a href=\"\/fr\/resource\/lapfo-enquetes\/\" target=\"_blank\" rel=\"noopener\">le service de police concern\u00e9<\/a> qui la m\u00e8ne, mais <a href=\"\/fr\/resource\/lapfo-enquetes\/\" target=\"_blank\" rel=\"noopener\">parfois<\/a>, c&#8217;est l&#8217;APFO ou un autre service de police qui s&#8217;en charge.<\/p>\n<p>Les enqu\u00eateurs ont g\u00e9n\u00e9ralement 4 mois pour faire leur travail et vous en rapporter les fruits.<\/p>\n<p>Si les enqu\u00eateurs concluent que le policier en cause vous a fait du mal et devrait \u00eatre p\u00e9nalis\u00e9 ou cong\u00e9di\u00e9, cette d\u00e9cision sera prise par\u00a0:<\/p>\n<ul>\n<li>la <a href=\"\/fr\/resource\/commission-ontarienne-darbitrage-et-de-decision-pour-la-police-capo\/\" target=\"_blank\" rel=\"noopener\">Commission d&#8217;arbitrage de la police de l&#8217;Ontario<\/a>, ou<\/li>\n<li>une personne \u00e0 qui la police a donn\u00e9 ce pouvoir.<\/li>\n<\/ul>\n<p>La mesure disciplinaire peut prendre diff\u00e9rentes formes.
