Si la m\u00e9diation fonctionne<\/h3>\n

Si vous et l’intim\u00e9 arrivez \u00e0 vous entendre, vous devez signer 2 documents :<\/p>\n

  1. Une entente de r\u00e8glement;<\/li>\n
  2. Une Confirmation de r\u00e8glement (formulaire\u00a025)<\/a>.<\/li>\n<\/ol>\n

    Entente de r\u00e8glement<\/strong><\/h3>\n

    Une entente de r\u00e8glement est un document qui d\u00e9crit comment les parties ont d\u00e9cid\u00e9 de r\u00e9gler leurs litiges. En g\u00e9n\u00e9ral, ce type d’entente est priv\u00e9 et confidentiel; autrement dit, vous ne pouvez parler \u00e0 personne de ce qu’elle contient. Tout ce que vous pouvez dire, c’est que vous avez sign\u00e9 un r\u00e8glement. Vous pouvez toutefois demander la permission de r\u00e9v\u00e9ler son contenu \u00e0 votre famille imm\u00e9diate.<\/p>\n

    Habituellement, l’entente indique que l’affaire est close et que vous renoncez \u00e0 porter d’autres actions en justice pour cette situation.<\/p>\n

    Formulaire Confirmation de r\u00e8glement<\/strong><\/h3>\n

    La Confirmation de r\u00e8glement (formulaire\u00a025)<\/a> est un document qui informe le Tribunal des droits de la personne de l’Ontario (TDPO) que vous et l’intim\u00e9 avez r\u00e9gl\u00e9 votre litige en m\u00e9diation.<\/p>\n

    Vous ou l’intim\u00e9 devez remplir ce document et l’envoyer par courriel au TDPO \u00e0 l’adresse HRTO.Registrar@ontario.ca<\/a> dans les 14\u00a0jours<\/strong> suivant la signature de l’entente de r\u00e8glement.<\/p>\n

    Apr\u00e8s r\u00e9ception du formulaire, le TDPO vous enverra, \u00e0 vous et \u00e0 l’intim\u00e9, une lettre qui confirme que l’affaire est r\u00e9gl\u00e9e, et fermera le dossier.<\/p>\n

    Si la m\u00e9diation ne fonctionne pas<\/h3>\n

    Plus de 70\u00a0% des m\u00e9diations se terminent par un r\u00e8glement. Cela dit, vous n’\u00eates pas oblig\u00e9 d’accepter un r\u00e8glement. Vous ne devez pas signer une entente qui ne vous convient pas. Il est de votre droit d’avoir une audience. N’oubliez pas que si vous signez un r\u00e8glement, vous ne pourrez pas changer d’id\u00e9e plus tard.<\/p>\n

    Si vous ne parvenez pas \u00e0 un r\u00e8glement, le TDPO fixera une date d’audience.
