D\u00e9cidez si vous avez besoin d&#8217;un sursis"},"content":{"rendered":"<p>Ce n&#8217;est pas parce que vous d\u00e9posez un appel que les peines contre vous seront mises en attente. Par exemple, votre permis de conduire peut encore \u00eatre suspendu. Si vous voulez \u00e9viter cela, il faut demander un \u00ab sursis \u00bb. Si vous l&#8217;obtenez, les peines contre vous seront suspendues jusqu&#8217;\u00e0 la fin de l&#8217;appel.<\/p>\n<p>Pour demander un sursis, il faut pr\u00e9senter une motion \u00e0 la cour d&#8217;appel. Vous trouverez le formulaire de motion au greffe du tribunal o\u00f9 votre proc\u00e8s a eu lieu ou \u00e0 celui de la cour d\u2019appel.<\/p>\n<h3>\u00c0 prouver<\/h3>\n<p>Pour obtenir un sursis, vous devez prouver que :<\/p>\n<ul>\n<li>votre appel est bien fond\u00e9, c&#8217;est-\u00e0-dire que vous avez des chances de gagner votre cause;<\/li>\n<li>vous subirez des \u00ab pr\u00e9judices irr\u00e9parables \u00bb si le sursis vous est refus\u00e9;<\/li>\n<li>les pr\u00e9judices que vous subirez sont plus grands que ceux que subira le gouvernement si le sursis vous est accord\u00e9.<\/li>\n<\/ul>\n<h3>Signifier et d\u00e9poser votre motion<\/h3>\n<p>Pour pr\u00e9senter une motion de sursis, vous devez avoir d\u00e9pos\u00e9 votre avis d&#8217;appel \u00e0 la cour.
