Sachez si vous pouvez payer apr\u00e8s que votre propri\u00e9taire a pr\u00e9sent\u00e9 une requ\u00eate \u00e0 la CLI"},"content":{"rendered":"<p>Si vous ne payez pas avant la date limite indiqu\u00e9e sur l&#8217;avis N4, votre <span class=\"no-glossary\">propri\u00e9taire<\/span> peut pr\u00e9senter une demande \u00e0 la Commission de la location immobili\u00e8re (CLI). La CLI ou votre <span class=\"no-glossary\">propri\u00e9taire<\/span> vous enverra:<\/p>\n<ul>\n<li>une copie de la L1: <a href=\"\/fr\/resource\/cli-formulaires\/\">Requ\u00eate en expulsion d&#8217;un locataire pour non-paiement du loyer et en paiement de l&#8217;arri\u00e9r\u00e9 de loyer<\/a>; et<\/li>\n<li>un avis d&#8217;audience.<\/li>\n<\/ul>\n<p>Votre <span class=\"no-glossary\">propri\u00e9taire<\/span> pourrait vous sugg\u00e9rer une entente de paiement <strong>apr\u00e8s<\/strong> avoir fait cette d\u00e9marche et vous pouvez \u00e9galement sugg\u00e9rer vous-m\u00eame une entente de paiement, ou un <a href=\"\/fr\/steps\/housing-law\/4-acceptez-la-m\u00e9diation-0\">m\u00e9diateur<\/a> travaillant pour la CLI pourrait le sugg\u00e9rer.<\/p>\n<div class=\"box\"><a href=\"https:\/\/tools.stepstojustice.ca\/fr\/droit-locatif\/entente-de-paiement\/\">Cliquez ici<\/a> pour voir \u00e0 quoi ressemble le formulaire d&#8217;entente\u00a0de paiement de la CLI et certaines des choses que vous devez\u00a0conna\u00eetre.<\/div>\n<p>Vous devez savoir que la signature d&#8217;une entente \u00e0 ce stade comporte de <strong>s\u00e9rieux risques<\/strong>. Par exemple, ces ententes \u00e0 ce stade peuvent inclure une clause indiquant que si vous manquez un paiement, votre <span class=\"no-glossary\">propri\u00e9taire<\/span> peut obtenir une ordonnance d&#8217;expulsion de la CLI <strong>sans vous donner d&#8217;avis ni d&#8217;audience. <\/strong>Vous <strong>n&#8217;\u00eates pas<\/strong> oblig\u00e9 d&#8217;accepter. Expliquez \u00e0 votre <span class=\"no-glossary\">propri\u00e9taire<\/span> qu&#8217;il peut toujours demander \u00e0 la CLI de rendre une ordonnance d&#8217;expulsion si vous manquez un paiement. La diff\u00e9rence est que vous aurez une audience, vous recevrez un avis d&#8217;audience et vous aurez la possibilit\u00e9 de fournir vos explications \u00e0 la CLI.<\/p>\n<p>Si votre <span class=\"no-glossary\">propri\u00e9taire<\/span> insiste sur l&#8217;entente en disant qu&#8217;il peut vous expulser sans pr\u00e9avis ni audience, vous n&#8217;avez pas \u00e0 signer l&#8217;entente. De plus, vous ne devriez signer que si vous \u00eates tr\u00e8s s\u00fbr de pouvoir effectuer tous les paiements int\u00e9gralement et \u00e0 temps.
