Allez \u00e0 l&#8217;audience si la CLI ne la reporte pas"},"content":{"rendered":"<p>Si la Commission de la location immobili\u00e8re (CLI) ne reporte pas votre audience, vous devrez alors y \u00eatre \u00e0 la date initialement pr\u00e9vue. Si c&#8217;est absolument impossible, vous pouvez envoyer quelqu&#8217;un pour vous y repr\u00e9senter.<\/p>\n<p>Si vous envoyez votre repr\u00e9sentant ou repr\u00e9sentante, vous devez lui remettre une note sign\u00e9e par vous pour confirmer qu&#8217;il a votre permission. Votre repr\u00e9sentant peut \u00eatre un avocat ou parajuriste autoris\u00e9. Vous pouvez aussi envoyer votre ami ou un ou une membre de votre famille.<\/p>\n<p>Si votre repr\u00e9sentant n&#8217;est <strong>pas <\/strong>un avocat ou parajuriste autoris\u00e9, alors vous ne pouvez pas le payer pour vous repr\u00e9senter \u00e0 votre audience. Si vous le payez, la CLI pourrait interdire \u00e0 cette personne de vous repr\u00e9senter, et dans ce cas, l&#8217;audience pourrait avoir lieu sans personne pour y d\u00e9fendre vos int\u00e9r\u00eats.<\/p>\n<p>Les r\u00e8gles concernant les repr\u00e9sentants qui ne sont ni avocats ni parajuristes se trouvent dans la <a href=\"\/fr\/resource\/directive-de-pratique-sur-la-representation-devant-la-commission-de-la-location-immobiliere\/\" target=\"_blank\" rel=\"noopener\">Directive de pratique sur la repr\u00e9sentation devant la Commission de la location immobili\u00e8re<\/a>.<\/p>\n<h3>Demandez le report de l&#8217;audience<\/h3>\n<p>Avant le d\u00e9but de votre audience, vous ou votre repr\u00e9sentant pouvez demander au locateur s&#8217;il accepterait de faire reporter l&#8217;audience. Si oui, vous devriez en informer le membre de la CLI d\u00e8s le d\u00e9but de l&#8217;audience.<\/p>\n<p>Si le locateur refuse, vous pouvez demander au membre de la CLI un ajournement au d\u00e9but de l&#8217;audience. L&#8217;\u00ab\u00a0ajournement\u00a0\u00bb, c&#8217;est la d\u00e9cision du membre de la CLI de reporter l&#8217;audience \u00e0 un autre jour en fixant une nouvelle date. Le membre de la CLI peut ajourner l&#8217;audience s&#8217;il est convaincu que vous avez une tr\u00e8s bonne raison de le demander.<\/p>\n<p>Si le membre de la CLI refuse, alors l&#8217;audience se tiendra probablement le jour pr\u00e9vu, et ce, m\u00eame si vous \u00eates absent ou n&#8217;\u00eates pas pr\u00eat. Vous ou votre repr\u00e9sentant \u00eates cens\u00e9 arriver \u00e0 l&#8217;audience le mieux pr\u00e9par\u00e9 possible.<\/p>\n<h3>Si vous n&#8217;allez pas \u00e0 l&#8217;audience<\/h3>\n<p>Si vous n&#8217;allez pas \u00e0 l&#8217;audience et n&#8217;y envoyez pas de repr\u00e9sentant, la CLI tiendra quand m\u00eame l&#8217;audience, et ordonnera probablement votre expulsion.<\/p>\n<p>Il y a des d\u00e9marches que vous pouvez faire pour tenter de conserver votre logement apr\u00e8s une ordonnance d&#8217;expulsion, mais vous devez agir vite.
