Pour savoir comment il s&#8217;applique, lire la question <a href=\"https:\/\/stepstojustice.ca\/fr\/questions\/housing-law\/quelle-est-laugmentation-de-loyer-maximale\/\">Quelle est l&#8217;augmentation de loyer maximale?<\/a><\/div>\n\n\n\n<p>Si le taux l\u00e9gal s&#8217;applique \u00e0 votre logement et que votre propri\u00e9taire veut vous imposer une hausse sup\u00e9rieure, il doit pr\u00e9senter une demande d&#8217;augmentation de loyer sup\u00e9rieure au taux l\u00e9gal \u00e0 la\u00a0Commission de la location immobili\u00e8re\u00a0(CLI).<\/p>\n\n\n\n<p>Votre propri\u00e9taire doit vous avoir remis un <a href=\"\/fr\/resource\/form-n1-notice-of-rent-increase\/\" target=\"_blank\" rel=\"noopener\">formulaire&nbsp;N1 \u2013 Avis d&#8217;augmentation de loyer<\/a> indiquant&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>qu&#8217;il a demand\u00e9 l&#8217;approbation de la hausse,\u00a0<strong>ou<\/strong><\/li>\n\n\n\n<li>que la CLI a d\u00e9j\u00e0 approuv\u00e9 la hausse.<\/li>\n<\/ul>\n\n\n\n<p>Votre propri\u00e9taire doit vous remettre cet avis au moins <strong>90&nbsp;jours<\/strong> avant la prise d&#8217;effet du nouveau loyer.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-vous-devez-payer-le-nouveau-loyer\">Vous devez payer le nouveau loyer<\/h3>\n\n\n\n<p>Vous pouvez d\u00e9cider de payer seulement le loyer et le montant \u00e9quivalant au taux l\u00e9gal jusqu&#8217;\u00e0 ce que la CLI rende une d\u00e9cision sur l&#8217;augmentation de loyer sup\u00e9rieure au taux l\u00e9gal.<\/p>\n\n\n\n<p>Si la CLI approuve l&#8217;augmentation, elle indiquera quand le propri\u00e9taire peut hausser le loyer; cette date peut \u00eatre pass\u00e9e. Elle indiquera aussi jusqu&#8217;\u00e0 quand les locataires ont pour payer la portion impay\u00e9e s&#8217;ils ont d\u00e9cid\u00e9 de payer uniquement le loyer et le montant \u00e9quivalant au taux l\u00e9gal.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-hausse-de-loyer-maximale\">Hausse de loyer maximale<\/h3>\n\n\n\n<p>La CLI utilise une formule complexe pour calculer l&#8217;augmentation sup\u00e9rieure au taux l\u00e9gal. Il n&#8217;y a <strong>pas de maximum<\/strong> pour une augmentation d\u00e9coulant d&#8217;une hausse des redevances ou imp\u00f4ts municipaux, mais dans la plupart des cas, les augmentations sont inf\u00e9rieures \u00e0 1 % au-dessus de l&#8217;augmentation pr\u00e9vue.
