Refugee claims

During the difficult situation in Afghanistan, the Refugee Protection Division (RPD) of the (IRB) plans to process refugee claims from Afghanistan more quickly.

All claims that can't be proceed quickly will get a full hearing. A claim can't be rejected without a hearing. At a refugee hearing, a member of the Refugee Board reviews your and decides to either accept or refuse your claim. Your evidence includes:

  • your Basis of Claim (BOC) form
  • what you say at your hearing
  • any other evidence like documents that prove your identity and the risk you face in your country
  • witnesses who can testify at your refugee hearing

Ask your lawyer if updating your BOC form with new evidence about the recent human rights situation in Afghanistan could convince the RPD to accept your case without a hearing.

Ask for your refugee claim to be processed earlier

You or your lawyer can contact the RPD Registry to ask them to schedule your refugee claim as soon as possible.

Refugee appeals

You can also ask to have your appeal at the Refugee Appeal Division (RAD) processed more quickly.

Ask your lawyer to ask if you should update your appeal to include new evidence about the situation in Afghanistan.

If you want your appeal to happen sooner, you or your lawyer can contact the RAD Registry to ask them to review your appeal as soon as possible.
