Can I move with my child after separation or divorce?
This question has an answer and 3 steps

1. Talk to your partner about the move

Let your partner know that you're thinking about moving before you make any plans to move. Tell them:

  • the reasons you want to move with your child
  • why you believe it is best for your child to move
  • what changes because of the move, for example, your child's daycare or school
  • how you plan to deal with changes to their access schedule because of the move

You can talk to your partner on your own, with the help of someone both of you trust, or with the help of a lawyer or mediator.

If you and your partner agree to change your parenting plan or separation agreement, you can make a new agreement that deals with the changes the move causes.

If you agree to change a court order, you can go to court and get a new order based on your agreement.

Talking to your partner may not be an option where there is a history of partner abuse.
