Guided Pathway for bringing a motion

CLEO’s Guided Pathway for bringing a motion is for people who are already involved in a Small Claims Court case and want to ask the court to make an order. This pathway can help you fill out a Notice of Motion and Supporting Affidavit (Form 15A).

Fill out Form 15A Notice of Motion and Supporting Affidavit using CLEO’s Guided Pathways

The Guided Pathways ask you a series of questions about your situation, give you information to help answer them, and create documents based on your answers.

The pathways are free to use. When you’re finished, you can save or print your forms. You will also get instructions about how to give them to the court.

Notice of Motion and Supporting Affidavit (Form 15A)

A motion is a request asking the court to make a decision about an issue in your case. You can only bring a motion after your Small Claims Court case has started.

This pathway can help you complete a Notice of Motion and Supporting Affidavit (Form 15A) for several common types of motions, including:

  • setting aside a default judgment
  • setting aside noting in default
  • assessing damages after a default judgment
  • stopping a garnishment
  • removing a writ
  • asking for permission to serve court documents another way (substituted service)

The pathway can also help you complete Form 15A for other types of motions. However, it provides less guidance for motions that are more complex.

You can use this pathway if: What you need to get started:
  • you are already involved in a Small Claims Court case and want to ask the court to make an order
  • you want to fill out a Notice of Motion and Supporting Affidavit (Form 15A)
  • you want to learn more about bringing a motion in Small Claims Court
  • a copy of the Plaintiff’s Claim
  • a copy of any Defence that has been served
  • information about the motion you want to bring
  • any documents that support your motion

The information and documents you need depend on the type of motion you are bringing.

If you want to use the pathway to learn more about Small Claims Court, you don’t need any information to start.
