Guided Pathway for enforcing your Small Claims Court judgment

CLEO’s Guided Pathway for enforcing your Small Claims Court judgment is for people who won their case in Small Claims Court and want to collect their money. This is called enforcing your judgment. The pathway can help you learn more about different enforcement options and fill out the forms you need.

The pathway can only help you enforce your judgment for money.

The Guided Pathways ask you a series of questions about your situation, give you information to help answer them, and create documents based on your answers.

Enforce your judgment using CLEO’s Guided Pathways

You can start taking steps to enforce your judgment, as soon as you win your case. Winning is no guarantee that the debtor (the person who owes you money) will pay you, or pay you on time. The court does not collect the money for you. But, there are steps you can take. The pathway can help you with these enforcement options:

  • Notice of Examination to ask for a hearing to question the debtor about their finances
  • Notice of Default of Payment to tell the court the debtor isn’t following their payment plan
  • Notice of Garnishment to get money from the debtor’s wages, bank account, or other source of money
  • Writ of Seizure and Sale of Land to make a claim against the debtor’s land as an incentive for them to pay what they owe you, or to get money from the sale of their land
  • Certificate of Judgment to enforce your judgment in a different jurisdiction or court area
You can use this pathway if: What you need to get started:
  • you want to enforce your Small Claims Court judgment for money
  • you want to learn more about the different enforcement options, and which one or ones may work best for your situation
  • a copy of the judgment you want to enforce
  • information about the person or organization (like a business) you want to collect money from
  • the amount of money they owe you
  • the amount of money they already paid you, if they paid you anything

If you want to use the pathway to learn more about the different enforcement options, you don’t need any information to start.
