2. Learn about the Consent and Capacity Board
You may not agree if your decides that you're not of consenting to a medical treatment. If this happens, you can apply to the Consent and Capacity Board.
Consent means that you agree to something.
The Board decides if the health-care provider is wrong to say that you're not mentally capable of agreeing to a specific treatment, like a surgery.
The Board cannot decide if you're capable of deciding about all treatments. This is because you may have capacity to make some decisions but not others. For example, you might be able to decide to get a flu shot but not about having surgery.
Who cannot apply to the Board
You cannot apply to the Board on this issue if:
- You have a .
- You have a that says the Board cannot review decisions about your treatment.
- You went to the Board about the same issue within the last 6 months.
Tell your health-care provider
It's important to tell your health-care provider that you're applying to the Board before they start your treatment. Unless it's an emergency, they cannot start your treatment if they know that you're applying to the Board.
Once you tell your health-care provider, you must act quickly.
You must send in your application to the Board within 48 hours of telling your health-care provider. If you do not do this, they can go ahead with your treatment if your agrees to it.
