1. Know if it’s trespass

Just because someone is on your property, it doesn't mean that it's trespass. Trespassing happens when someone enters your property when it is not allowed. This can be for many reasons, such as:

  • when you tell them to leave and they don't leave
  • when you post a sign saying they cannot enter but they enter
  • when there is a sign saying “no dogs” but they enter your property and walk their dog in an area that is fenced off

Even if one of these examples is your situation, there are still some times when someone can be on your property. For example, it's not usually trespassing for someone to use the walkway to get to your front door. Another example is an emergency.
