4. File your evidence and legal argument

You must file your Appellant's Record within 45 days of receiving the 's (RPD) written decision.

It's important to have a lawyer or licensed representative prepare and file it for you.

How to file

File your Appellant's Record to the correct RAD Directory. You can file:

  • electronically by email or the My Case portal depending on your situation
  • by mail, courier, or fax, or in-person in some cities

If you file by email, save the email to prove you sent it.

If you file by mail or in-person

Make 3 copies and deliver the original and one copy to the correct RAD registry. Keep one copy for yourself.

It's best to use registered mail so you have proof of delivery. Or, if you deliver it yourself, the registrar will stamp your copy as proof that it was delivered.

Extension of time

If you miss the deadline to file your Appellant's Record, you must apply for an extension of time when you file it.

Explain why you could not file it on time and what steps you took to file on time. For example, if you were sick, provide a doctor's note. The RAD might refuse your request and dismiss your appeal. If this happens, get legal advice about asking to reopen your appeal or applying to the Federal Court for judicial review.

Minister gets involved

The Minister could sometimes get involved in your case. If this happens, the Minister submits written arguments, and you have the right to reply within 15 days of receiving them. Learn more in: The Minister is involved in my RAD appeal. What do I do?

Contact information

Tell the RAD, Immigration, Refugees and Citizenship Canada (IRCC), and Canada Border Services Agency (CBSA) in writing if you change your:

  • mailing address,
  • phone number, or
  • email address.

If you plan to move, update your contact information before you move.

Tell the RAD if you change your representative. If you have a representative, the RAD sends all communications to them.
