I can’t go to my eviction hearing. Can I change the hearing date?Fill out the 's (LTB's) Request to Reschedule a Hearing form. If the landlord and the other have agreed to reschedule the hearing and you have this in writing, attach it to the form. Also, on the form, you must include:
- your reasons for wanting to change the hearing date
- a list of all the dates when you, your landlord, the other parties, your witnesses, or the representatives are not available, for 90 days after the original hearing date
If your landlord and the other parties didn't agree to change the date, you will need a very good reason why you can't go ahead on the date the LTB set. For example, you have an important medical appointment that you can't reschedule. The LTB is more likely to change the date if the reason is something that you can't control.
If you have any that helps prove that you can't go on the original hearing date, attach it to the request form.
When you have filled out and signed the form, send it to the LTB by:
- email to LTB@ontario.ca,
- mail or courier to the closest LTB office,
- fax to 1-833-610-2242 or 416-326-6455, or
- online, through the Tribunals Ontario Portal.
Make sure the LTB receives it no later than 5 days before the hearing date. If you are sending the form by email, remember to put your LTB file number in the subject line of the email.
You should also send a copy of the form to the landlord and all other parties on your .
Emergency requests
Sometimes you might not have enough time to complete and send the Request to Reschedule a Hearing form before the 5-day deadline. For example:
- you find out 2 days before the hearing date that a close family member has died
- you have a serious accident and you're in the hospital
- you're caring for a very sick relative and the replacement caregiver suddenly cancels on you
If an emergency happens on any day before your hearing, you should still send the LTB your Request to Reschedule a Hearing form. On the form, explain why you could not meet the 5-day deadline. Attach any evidence you have that supports the reasons why you could not meet the deadline.
If an emergency happens on the day of your hearing, call the LTB at 1-888-332-3234
as soon as you can. You might not be able to get through to the LTB on the phone, so you should also email the LTB at LTB@ontario.ca. Explain why you can't come to the hearing. Remember to put your file number in the subject line of your email.
