2. Gather evidence

It's important to get as much as you can that the person did not move into the rental unit, took too long to move in, or did not live there for at least one year.

To check if they moved in, you can:

  • see if the place is listed for rent or for sale
  • talk with your old neighbours
  • talk with the people who live in the unit
  • see if the place looks lived in

It's a good idea to check these things over a of four months or more, in case things change. Keep detailed notes about what you learn. Write the date on your notes.

If you talk to people, you should ask:

  • their name
  • their contact information
  • if they are comfortable being a witness

If the person is comfortable being a witness, the best way for them to share the information they know is to come to your (LTB) hearing. They can also share the information in a letter. Make sure they sign and date the letter. Keep in mind that the LTB takes witness information more seriously if the person speaks at the hearing rather than if they write a letter.

Taking pictures can be a good way to show the unit is empty. For example:

  • Are the curtains always closed, or are there no curtains?
  • Is the snow shovelled or the grass cut?
  • Is there mail piled up outside?
  • Are the lights never on at night?

If you're taking pictures, remember to stay off private property unless you have permission from the people living there.
