Can my landlord install a security camera on the rental property?If your landlord does not fix the problem, you can apply to the Landlord and Tenant Board (LTB) on a Form T2: Application about Tenant Rights.
The reasons that you can choose on Form T2 are:
- Reason 3: your landlord substantially interfered with your reasonable enjoyment of your rental unit or building
- Reason 4: your landlord harassed, coerced, obstructed, threatened or interfered with you
Harassment happens when someone does something that they know, or should know, will bother you.
It is best to apply within one year of when you first had problems with the security camera.
The LTB may order the landlord to:
- move or take down a security camera
- stop harassing you
- pay a rent abatement, which means your landlord gives you back some of the rent you paid
- pay you general damages for your pain and suffering
- pay you out-of-pocket expenses
- pay you the difference in rent for one year if you have moved out with a higher rent
- pay a fine to the LTB
You may choose any listed on Form T2. You can also tell the LTB what other remedies you want.
When you apply, the LTB will set a date for a hearing where you and the landlord can each explain the situation to a member of the LTB.
It is your responsibility to convince the there was a problem. You should be prepared to show how the security cameras affected your privacy, use, and reasonable enjoyment of the unit.
