3. Get your decision

After your hearing, a Member of the (RPD) will make a decision.

If the RPD decides to let you keep your refugee protection, the cessation case usually ends.

In most cessation cases, the RPD decides to take away a person's protection.

Apply for judicial review

If your status is ceased, you cannot appeal to the (RAD).

But you can ask the Federal Court to review your case. This is called judicial review. You must apply for within 15 days of when you or your representative is notified of the RPD's decision. It's very important to have a lawyer represent you in your judicial review. This is not something you should try to do on your own.

If the Federal Court decides that the RPD's decision was not reasonable or the process was not fair, then they can order the RPD to hold a new cessation hearing with a new Member.
