How and when must I report a workplace injury or illness?The Workplace Safety and Insurance Board (WSIB) can take 12 weeks or more to decide a claim. They must send you their decision in writing.
If you do not agree with the decision, you can appeal.
The process is started by filling out an Intent to object form.
The decision letter from the WSIB should tell you:
- how to get an Intent to object form, and
- the deadline for the WSIB to get the form, which is usually 6 months from the date of the WSIB decision. But sometimes it's as short as 30 days.
The WSIB takes these deadlines very seriously.
If the WSIB's decision letter does not include a deadline, send the Intent to object form right away. To be safe, you want them to get the form within 30 days of the date of the decision.
