1. Check for problems with the notice

The (LTB) can dismiss your landlord's case if there are problems with the Form N12: Notice to End your Tenancy Because the Landlord, a Purchaser or a Family Member Requires the Rental Unit that your landlord gave you.

For example:

  • you did not get the Form N12 within the right time
  • the N12 does not tell you who wants to move in.

Compensation from your landlord

If your landlord gives you a 60-day N12 notice, they must do one of the following before the :

  • offer you another acceptable unit to move to,
  • pay you at least one month's rent, or
  • let you skip paying rent for at least one month.

The date is the date that your landlord wants you to move out.

No compensation for 120-day notice

For their personal use, if your landlord gives you a 120-day N12 notice before the termination date, there is no compensation or offer of another unit.
