COVID-19 and trials

The court is rescheduling trials that were paused because of COVID-19. They are also scheduling new trials. The cases that have been waiting the longest will be scheduled first. So it might take some time to get a date.

Before you can ask for a trial date, you must have had a settlement conference.

To ask the court to set a date for a trial, you must complete Form 9B: Request to Clerk. You can ask a at a Small Claims Court counter for a copy of this form. Check off the box asking the clerk to schedule a trial. Then the form with the court.

Only ask for a trial date if you and the  are sure you can't reach an agreement.

If you want help to reach an agreement, you can try  (ADR), such as working with a mediator. The ADR Institute of Ontario has a directory to help you find a mediator.
